The parties represented that settlement offers are being exchanged and
discussions continue. The parties represented that there are no compliance issues, and
that the only issue is the monetary penalty. By agreement, respondent’s answer is now
due to be filed on or before August 18, 2008. The respondent represented that it will file
its appearance.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on July 17, 2008, at 10:30 a.m. The telephonic
conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
