HEARING OFFICER ORDER
The parties are advised that this matter has been assigned to the hearing officer
identified below. From this date forward, any pleading filed with the Clerk of the Board
in this matter must also be served individually on the hearing officer.
The parties are directed to participate in a telephone status conference with the
hearing officer at 2:30 p.m. on January 8, 2008. The status conference shall be initiated
by the petitioner.
Under the current deadline, a hearing must be held before March 1, 2008. The
hearing will be set at this status conference unless petitioner agrees to file an additional
deadline waiver. Petitioner’s attorney shall speak to petitioner before the status
conference to discuss the waiver issue, and must be prepared to agree to a date certain
waiver. For future reference, petitioner is advised that the Board’s procedural rules
mandate that waivers be at least 40 days (Section 101.308(c)(2)).
The decision deadline is May 1, 2008.
