On January 24, 2008 all parties appeared at a telephonic pre-hearing conference with the
hearing officer. The parties represented that they are ready to proceed with the hearing scheduled
for January 29, 2008. The respondent represented that it intends to file a motion to withdraw its
previously filed motion to cancel the hearing and its motion for an extension of time to file the
record. Petitioner represented that it intends to present one witness at the hearing.
