HEARING OFFICER ORDER
On January 24, 2008, a telephonic status conference was held. Respondent Rod
Bennett Construction, Inc. (Bennett), did not appear. The complainant represented that
Bennett it had a scheduling conflict. The parties represented that they are awaiting the
Board’s decision on Bennett’s motion for leave to file a third party complaint. The
complainant represented that it does not intend to file a response. The complainant
represented that settlement offers have been made. By agreement, respondent Felker
Pharmacy, Inc., was given until March 28, 2008, to file its answer.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on March 13, 2008, at 9:45 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
