JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the
Illinois Environmental Protection Agency by sections 4(e) and 31.1 of the Illinois
Environmental Protection Act ("Act"), 415 ILCS 5/4(e), 5/31.1, and delegated to
Vermilion County pursuant to section 4(r) of the Act, 415 ILCS 5/4(r).
FACTS
1.
Respondent, Illinois Landfill, Inc., is, and was at all times relevant to this
Administrative Citation, the operator of a facility located in Hoopeston,
County of Vermilion, State of Illinois.
2.
Said property is operated as a sanitary landfill, operated under Illinois
Environmental Protection Agency Operating Permit No. 1996-301LF Mod 26,
and designated with Illinois Environmental Protection Agency Site Code No.
1830450009.
3.
On April 21, 2008, LeeAnn Chezem of the Vermilion County Health
Department inspected the above-described property. LeeAnn Chezem's
Affidavit and a copy of her inspection report are attached hereto and made a
part hereof by reference.
VIOLATIONS
On the basis of the direct observation of LeeAnn Chezem, the County of
Vermilion has determined that on April 21, 2008, Respondent was conducting a sanitary
landfill operation at the above-described facility, which is required to have a permit
pursuant to 415 ILCS 5/21(d) of the Act, 415 ILCS 5/21(d), in a manner which resulted
in the following condition:
litter from a previous operating day was present at the site at the time of the
above-mentioned observations and inspection, in violation of section 21(o)(12) of
the Act, 415 ILCS 5/21(o)(12), which provides no person shall conduct a sanitary
landfill operation in a manner which results in litter remaining from any previous
operating day.
CIVIL PENALTY
Pursuant to section 42(b)(4) of the Act, 415 ILCS 5/42(b)(4), Respondent herein
is subject to a civil penalty of Five Hundred Dollars ($500.00) for each of the above-
mentioned violations. Additionally, should Respondent elect to petition the Illinois
Pollution Control Board under the review process described herein, and if there is a
finding of the violation alleged herein after an adjudicatory hearing, Respondent shall be
assessed the associated hearing costs incurred by the Illinois Pollution Control Board, in
addition to the Five Hundred Dollar ($500.00) statutory penalty for each violation.
PROCEDURE FOR CONTESTING
THIS ADMINISTRATIVE CITATION
You have the right to contest this Administrative Citation under section 31.1(d) of
the Act, 415 ILCS 5/31.1(d). If you elect to contest this Administrative Citation, you
must file a Petition for Review with the Clerk of the Illinois Pollution Control Board, at
the State of Illinois Center, 100 West Randolph Street, Suite 11-500, Chicago, Illinois
60601. Such Petition for Review must be filed within thirty-five (35) days of the date of
service of this Administrative Citation, or a default judgment will be issued by the Illinois
Pollution Control Board. A copy of the Petition for Review should be filed with the
Vermilion County State's Attorney's Office, 7 North Vermilion Street, Danville, Illinois
61832.
If you acknowledge the violation cited herein, the civil penalty specified above
shall be due and payable no later than July 18, 2008. If you do not petition the Illinois
Pollution Control Board for review of this Administrative Citation within thirty-five (35)
days of service hereof and have not paid the civil penalty by the due date stated above, or
if you elect to contest this Administrative Citation, any judgment rendered shall specify
the due date of the statutory civil penalty and any costs assessed against you.
When payment is made, checks shall be made payable in equal amounts (50% of
the total penalty each) to:
(1)
the Illinois Environmental Protection Trust Fund and mailed to the attention of
Fiscal Services, Illinois Environmental Protection Agency, 1021 North Grand Avenue
East, P.O. Box 19276, Springfield, Illinois 62794-9276; and
(2)
the County of Vermilion, Illinois, and mailed to the attention of Vermilion
County Health Department, 200 South College Street, Danville, Illinois 61832.
Respondent shall complete and return the enclosed Remittance Forms with
payments to ensure proper documentation of payment.
If any civil penalty, by reason of acknowledgment, default or finding after
adjudicatory hearing, is not paid when due, the Vermilion County State's Attorney may
initiate proceedings in the Circuit Court to collect said civil penalty. In addition to the
previously assessed civil penalty and any hearing costs of the Illinois Pollution Control
Board, the State's Attorney's Office will seek to recover its costs of litigation.

The Affiant, LeeAnn Chezem, being first duly sworn, voluntarily deposes and
states as follows:
1. Affiant is a field inspector employed by the Vermilion County Health
Department and has been so employed at all times pertinent hereto.
2.
On April 21, 2008, between 6:20 and 7:20 a.m., Affiant conducted an
inspection of a sanitary landfill within the County of Vermilion, State of
Illinois, known as Illinois Landfill, Inc., operating under IEPA Permit No.
1996-301LF Mod 26.
3.
Affiant inspected the Illinois Landfill, Inc. site by an on-site inspection, which
included walking on the site.
4.
Prior to said inspection, Affiant had reviewed Illinois Environmental
Protection Agency permits issued to the subject site.
5.
As a result of the activities referred to in paragraphs 2, 3 and 4 above, Affiant
completed the Solid Waste Landfill Inspection Checklist, with the
accompanying Inspection Report Narrative, Site Sketch and photographs,
attached hereto and made a part hereof, which, to the best of Affiant's
knowledge and belief, is an accurate representation of Affiant's observations
and factual conclusions with respect to Illinois Landfill, Inc. on April 21,
2008.

INSPECTION REPORT NARRATIVE
This peimitted landfill was inspected on April 21, 2008, by Lee Ann Chezem, of the
Vermilion County Health Department. The weather was sunny and approximately 55
degrees.
I arrived at the facility at approximately 6:20am and met with Ken and Cassie Samet. I
proceeded to the active area, where the tarp had been placed over the previous day's
waste(photo 1). Litter was observed to the north of the covered waste (photos 2,3,5,6,7)
and a small amount of litter was observed in two of the fencing used to contain trash from
blowing away from the active area (photo 4).
Final cover for several slopes of the inactive areas surrounding the facility were showing
signs of erosion and loss of vegetation (photos 8,9,11,12,13).
Ameren continues to dispose of contaminated dirt at this site. Approximately 800-900
ton of dirt has been accepted daily. Three trucks were observed waiting to dump and the
drivers indicated this project is expected to be completed in the near future.
Daily levels of waste were estimated to be 1000 tons with 800-900 of this being
Ameren's disposal of dirt. Spent bleaching clay had been accepted from Incobrasa in
Gilman. Between January 16, 2008 and March 21, 2008, 15 loads of this material had
been accepted.
Weekly load inspections of Central Illinois Disposal, Vermilion Waste and Paxton
Disposal were completed on 3/28/08, 4/3/08 and 4/4/08. I did not locate inspections for
the week of 4/7/08 or 4/14/08.
The permit for this site expired on January 15, 2008. An application was submitted in a
timely manner. Additional information was requested as well as comments pertaining to
the permit.

The Vermilion County Health Department submitted comments regarding the size of
chipped tires that could be utilized for the final cover. These comments were returned to
the permit section of the Illinois Environmental Protection Agency in February 2008.
At the time of my inspection, litter, erosion and loss of vegetation on the final cover were
observed on site. The inspection was completed at 7:20am.

The following violations are alleged pursuant to this report.
1.
Section 21(d)(1) of the Act:..Conduct any waste-storage, waste-treatment, or
waste-disposal operation without a permit or in violation of Any Conditions of
a permit
2.
Section 21 (d) (2) of the Act:... Conduct any waste-storage, waste-treatment,
or waste disposal operation... in violation of any regulations or standards
adopted by the Board under the Act. Violations of the Illinois Pollution
Control Board Regulations were observed at the site where waste storage,
waste-treatment, or waste-disposal operations were taking place.
3. Section 21 (e) of the Act: ...dispose, treat, store or abandon any waste...except
at a site or facility which meets the requirements of this Act and of regulations
and standards thereunder. The storage and disposal of waste was occurring at
a site which did not meet the requirements of the Illinois Environmental
Protection Act and the Illinois Control Board Regulations.
4. Section 21 (o)(12) of the Act: Conduct a sanitary landfill operation which is
required to have a permit under subsection (d) of this Section, in a manner
which results in any of the following conditions: Failure to collect and contain
litter by the end of each operating day.

35 Illinois Administrative Code Section 811.107(K)(1); Litter Control...the
operator must patrol the facility daily to check for litter accumulation. All
litter must be collected and placed in the fill or in a secure, covered container
for later disposal.

35 Illinois Administrative Code Section 811.322 (a); Grade Capable of
Supporting Vegetation and Minimizing Erosion...All fmal slopes shall be
designed and constructed to a grade capable of supporting vegetation which
minimizes erosion.
The following violations are alleged pursuant to this report continued.

35 Illinois Administrative Code 811.322 (c) (1); Vegetation shall be promoted
on all reconstructed surfaces to minimize wind and water erosion of the final
protective cover.

35 Illinois Administrative Code Section 811.322 (c) (1) (a); Random Load
Inspections...An inspector designated by the facility shall examine at least
three random loads of solid waste delivered to the landfill on a random day
each week. The drivers randomly selected by the inspector shall be directed
to discharge their loads at a separate, designate location within the facility.
The facility shall conduct a detailed inspection of the discharged material for
any regulated hazardous or other unacceptable wastes that may be present.
