HEARING REPORT
On October 21, 2008, a hearing in this matter was held at the Perry County
Courthouse in Pinckneyville, Illinois. Attorney Michelle Ryan appeared on behalf of the
complainant. Respondent did not appear.
Witness Credibility

Based upon my legal judgment, experience, and observations at hearing, I find that the
credibility of witness is not an issue in this matter.
Exhibits
Complainant’s Exhibit 1 consisted of the open dump inspection checklist dated
February 29, 2008. The exhibit was admitted into the record. Additionally, complainant
filed a substitute page of the complaint. The Board will consider the issues relevant to
that page substitution.
Briefing Schedule
The transcript is due by October 31, 2008. Complainant will file its brief by November
13, 2008. Respondent’s brief, if any, is due by November 26, 2008. If the Board does
not receive respondent’s brief by December 1, 2008, it shall be assumed that no brief will
be filed. The mailbox rule will apply.
