    ORDER OF THE BOARD (by G.T. Girard):
    On November 17, 2006, the parties timely filed a joint notice to extend the 35-day period
    within which the City of Geneva (City) may appeal an October 13, 2006 determination of the
    Illinois Environmental Protection Agency (Agency).

    Adm. Code 105.402, 105.406. The Agency issued a permit, subject to conditions, under the
    National Pollutant Discharge Elimination System (NPDES) for the City’s waste water treatment
    (WWTP) plant; the City objects to the dissolved oxygen and copper limits. The City’s WWTP is
    located at 602 Crissey Avenue, in Geneva, Kane County.
    The Board extends the appeal period until February 15, 2007 (125 days after the October 13,
    2006 permit issuance date), as the parties request.

    Code 105.406. If the City fails to file an appeal on or before that date, the Board will dismiss this
    case and close the docket.
