    (90-Day Extension)
ORDER OF THE BOARD (by G.T. Girard):
On November 16, 2006, the parties timely filed a joint notice to extend the 35-day period
within which the City of Joliet (City) may appeal an October 5, 2006 determination of the
    Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40(a)(1) (2004); 35 Ill.
Adm. Code 105.402, 105.406. The Agency issued a permit, subject to conditions, governing the
land application of anaerobically digested sewage sludge to agricultural land; the City objects to
the radium limits in Special Condition 2. The City generates the sludge at the Joliet East, Joliet
West, and Aux Sable sewage treatment plants in Joliet, Will County.
The Board extends the appeal period until February 12, 2007 (125 days after the October 10,
2006 permit receipt date), as the parties request.
    See
    415 ILCS 5/40(a)(1) (2004); 35 Ill. Adm. Code
105.406. If the City fails to file an appeal on or before that date, the Board will dismiss this case and
    close the docket.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on December 7, 2006, by a vote of 4-0.
    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
