HEARING OFFICER ORDER
On December 4, 2006, the parties participated in a telephone status conference
with the hearing officer. Complainant reports that there are no remaining compliance
issues, and that the penalty amounts are being negotiated separately for each party.
Complainant agrees that respondents may defer the filing of their answers to the
complaint until such time as it appears that a hearing may be needed. Respondent
Provena is considering a supplemental environmental project, and respondent Cemetery
Association has submitted financial information for consideration by the Illinois
Environmental Protection Agency.
The parties are directed to participate in a telephone status conference with the
hearing officer at 9:30 a.m. (Provena) and 9:45 a.m. (Cemetery Association) on February
5, 2007. The status conference shall be initiated by the complainant.
