HEARING OFFICER ORDER
On October 4, 2007, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that discussions have been ongoing and that
the respondent expects to file a pleading addressing the matter on or before November 5,
2007. It is also anticipated that the petitioner will file response in the form of a motion to
stay the proceedings on or before November 19, 2007. Petitioner represented that it will
file an additional 60-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to appear at a telephonic pre-
hearing conference with the hearing officer on December 13, 2007, at 11:30 a.m. The
telephonic conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
