HEARING OFFICER ORDER
On March 13, 2008, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that discussions continue and that operations
have begun at the site in furtherance of resolving the issues in this matter. The petitioner
represented that it will file an additional motion to stay these proceedings to and
including June 15, 2008. Finally, the petitioner represented that it will file an additional
90-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to appear at a telephonic pre-
hearing conference with the hearing officer on May 15, 2008, at 1:15 p.m. The
telephonic conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
