    (NPDES Permit Appeal)
ORDER OF THE BOARD (by G.T. Girard):
On March 2, 2007, the petitioner, K.A. Steel Chemical, Inc. (K.A. Steel), filed a motion
to voluntarily dismiss this National Pollutant Discharge Elimination System (NPDES) permit
appeal. K.A. Steel states that it has agreed with the respondent, the Illinois Environmental
Protection Agency (Agency), on the terms of a modified NPDES permit. According to K.A.
Steel’s motion, the Agency received no public comments on the proposed issuance of the
modified permit, and the Agency will issue the modified permit to K.A. Steel upon the dismissal
of this appeal. The Board grants K.A. Steel’s motion, dismisses this case, and closes the docket.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on March 15, 2007, by a vote of 4-0.
    Dorothy M. Gunn, Clerk
