JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31
.1 of the Illinois Environmental Protection Act, 415
ILCS 5/31 .1 (2004) .
FACTS
1 .
That Waste Management of Illinois Inc . is the permitted operator and CT Corporation
System is the registered agent ("Respondents") of a facility located at 11501 W
. Cottonwood Road,
Brimfield, Peoria County, Illinois
.
2 .
That said facility is a sanitary landfill, operating under Illinois Environmental
Protection Agency Permit No
. 1996-089-LF, and is designated with Site Code No . 1438165003 .
The facility is commonly known to the Illinois Environmental Protection Agency as Peoria
City/County Landfill #2 .
3 .
That Respondents have operated said facility at all times pertinent hereto .

That on January 10, 2007, James Jones of the Illinois Environmental Protection
Agency's Peoria Regional Office inspected the above-referenced facility . A copy of his inspection
report setting forth the results of said inspection
is attached hereto and made a part hereof.
VIOLATIONS
Based upon direct observations made by James Jones during the course of his January 10,
2007 inspection of the above-referenced facility, the Illinois Environmental Protection Agency has
determined that Respondents violated the Illinois
Environmental Protection Act (hereinafter, the
"Act") as follows :
(1) That Respondents conducted a sanitary landfill in a manner which resulted in the failure
to collect and contain litter by the end of each operating
day, a violation of Section
21(o)(12) of the Act, 415 ILCS 5/21
(o)(12) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4) of the Act, 415 ILCS 5142(b)(4) (2004), Respondents are
subject to a civil penalty of Five Hundred Dollars ($500 .00) for each of the violations identified
above, for a total of Five Hundred Dollars ($500 .00) . If Respondents elect not to petition the Illinois
Pollution Control Board, the statutory civil penalty specified above shall be due and payable no later
than March 30, 2007, unless otherwise provided by order of the Illinois Pollution Control Board .
If Respondents elect to contest this Administrative Citation
by petitioning the Illinois Pollution
Control Board in accordance with Section 31 .1 of the Act, 415 ILCS 5/31 .1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs
incurred by the Illinois Environmental

Protection Agency and the Illinois Pollution Control Board . Those hearing costs shall be assessed
in addition to the statutory civil penalty.
Pursuant to Section 31 .1 (d)(1) of the Act, 415 ILCS 5/31
.1 (d)(1)
(2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and a finding of violation as
alleged herein, and shall impose the statutory civil penalty specified above .
When payment is made, Respondents' check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P
.O. Box 19276, Springfield,
Illinois 62794-9276 . Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment .
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received
. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued .

PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31 .1 of the Act, 415 ILCS 5/31/1 (2004) . If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601 . A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276
. Section 31 .1 of the Act provides that any Petition for Review shall be filed
within thirty-five (35) days of the date of service of this Administrative Citation orthe Illinois Pollution
Control Board shall enter a default judgment against the Respondents .

NARRATIVE
On Wednesday, January 10, 2007, I (James Jones) performed a solid waste inspection at Peoria
City/County Landfill #2 in Brimfield . I arrived at the facility at 6 :04a.m . The gates to the
landfill were opened upon my arrival . Photograph #1 depicts the open gate . The inspection of
the landfill began in Cell 2 at daybreak at approximately 6 :40 a .m.
Peoria City/County Landfill #2 is owned by the Joint City of Peoria-County of Peoria Solid
Waste Disposal Board and operated by Waste Management of Illinois, Inc . Permit No. 1996-
089-LF was issued to the owner/operator on December 20, 1996 . Peoria City/County Landfill #2
is a new municipal solid waste and nonhazardous special waste landfill consisting of
approximately 99 .6 acres with 60 .0 acres of disposal area
. The landfill's waste volume consists
primarily of municipal solid waste, declassified special waste, and special waste . The landfilling
sequence for the development of the landfill consists of 10 cells . The first cell filled was Cell 1
followed by Cells 2 and 3 .
Peoria City/County Landfill #2 began operating in Cell 1 in March 1998 . To date the facility has
filled Cells 1, 2, 3, 4, and 10
. In October 2002, the facility requested a Significant Modification
permit to develop future landfill cells in non-sequential order . The Agency approved the request .
On January 16, 2003, the Agency approved the operating authorization for Cell 10 in
Modification No. 45 to Permit No . 1996-089-LF . In December 2004, the facility developed Cell
#9 and began landfilling operations shortly thereafter . The facility is currently operating in Cell
#9. On September 14, 2006, an application (Log No . 2006-346) to renew the Permit No. 1996-
089 was received by the Illinois EPA . Permit No. 1996-089-LF expired on December 15, 2006.
The landfill is allowed to continue to accept waste while the permit renewal is under review .
During the solid waste landfill inspection, I began photographing the physical condition of Cell
#2, which is depicted in photographs #2 through #20, to include the previous day's active area
(Tuesday, January 09, 2007) that is depicted in photographs #2 and #3 . The area was located at
the top of Cell #2 in the northeast corner of the Cell . The January 09, 2007 active area was
adequately covered with alternate daily cover (ADC), but wind blown uncollected litter from the
active area was strewn along the east slope of Cell 2 (see photographs #4 through #20) . The
uncollected litter covered an area of approximately 300 feet in length and 40 foot in width along
the upper terrace of the east slope of Cell 2 . According to Steve Harenberg, District Manager of
the landfill, LABOR READY employees were brought to the landfill to pick up the litter which
was placed in white plastic garbage bags for placement into the active face . A review of the
LABOR READY work ticket for January 9, 2007 indicates three workers worked a total of 9'/z
hours each picking up litter
. On the day of the inspection (January 10, 2007), Mr . Harenberg
informed me that three employees from LABOR READY were being brought to the landfill to
join two Waste Management employees, to pick up the remainder of the uncollected litter from
the previous day .
Following the inspection of Cell #2 and the 01/09/07 active area, I went to the landfill office to
complete the remainder of the 811 landfill inspection, which consisted of a review of the

following documents : the facility's load checking program ; alternate daily cover (ADC) logs ;
leachate monitoring, collection and re-circulation records ; manifests ; and waste stream permits .
I departed the landfill at approximately 9 :30 a.m. To the best of my knowledge the three
LABOR READY employees and two Waste Management employees were still picking up litter .
Later on that day, Mr . Harenberg called my office to tell me that the employees had picked up all
of the litter by 2 :00 p .m . that day .
Based on my findings during the 01/10/07 landfill inspection, the following apparent violations
were observed and checked on the Landfill Inspection Checklist :
1 .
Pursuant to Section 21(d)(1) of the Act, in relevant part, no person shall conduct any
waste-storage, waste-treatment, or waste-disposal operation without a permit granted by
the Agency or in violation of any conditions imposed by such permit, including periodic
reports and full access to adequate records and the inspection of facilities, as may be
necessary to assure compliance with this Act and with regulations and standards adopted
there under.
A violation of Section 21(d)(1) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(d)(I)) is alleged for the following reason : the facility operator conducted a
waste-disposal operation in violation of Section II, conditions 2L, and 3, page 6 of
Permit No
. 1996-089-LF (Modification No. 55).
2 .
Pursuant to Section 21(d)(2) of the Act, no person shall conduct any waste-storage,
waste-treatment, or waste-disposal operation in violation of any regulations or standards
adopted by the Board under this Act .
A violation of Section 21(d)(2) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(d)(2)) is alleged for the following reason : the facility operator conducted a
waste-disposal operation in violation of Section 811 .107(k) of the Regulations .
3 . Pursuant to Section 21(e) of the Act, no person shall dispose, treat, store or abandon any
waste, or transport any waste into this State for disposal, treatment, storage or
abandonment, except at a site or facility which meets the requirements of this Act and of
regulations and standards there under .
A violation of Section 21(e) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(e)) is alleged for the following reason : the facility operator disposed of waste at a
site that does not meet the requirements of Sections 21(d)(1), 21(d)(2), and 21(o)(12)
of the Act and Section 811 .107(k) of the Regulations .
4 .
Pursuant to Section 21(o)(12) of the Act, no person shall conduct a sanitary landfill
operation which is required to have a permit under subsection (d) of this Section, in a

manner which results in failure to collect and contain litter from the site by the end of
each operating day
.
A violation of Section 21(o)(12) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(o)(12)) is alleged for the following reason
: the facility operator conducted a
sanitary landfill operation in a manner which resulted in litter not being collected
and contained from the site by the end of the operating day
.
5 .
Pursuant to 35 Ill . Adm
. Code 811 .107(k), the operator shall patrol the facility daily to
check for litter accumulation
. All litter shall be collected and placed in the fill or in a
secure, covered container for later disposal
. The facility shall not accept solid waste from
vehicles that do not utilize devices such as covers or tarpaulins to control litter, unless the
nature of the solid waste load is such that it cannot cause any litter during its
transportation to the facility
.
A violation of 35 Ill . Adm. Code 811
.107(k) is alleged for the following reason : the
facility operator failed to collect and place all litter from the site in the till or in a
secure covered container for later disposal at the end of the operating day .
