JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31
.1 of the Illinois Environmental Protection Act, 415
ILCS 5/31
.1 (2004) .
FACTS
1 .
That Gere Properties, Inc .is the permitted owner, Perry Ridge Landfill, Inc
. is the
permitted operator, and Mike Whitlock is the certified operator in responsible charge (collectively
"Respondents") of a facility located at 6305 Sacred Heart Drive, Du Qioin, Perry County,
Illinois .
2.
That said facility is a sanitary landfill, operating under Illinois Environmental
Protection Agency Permit No
. 2000-064-LF, and is designated with Site Code No . 1450105039 .
The facility is commonly known to the Illinois
Environmental Protection Agency as
Perry Ridge Landfill .
3.
That Respondents have owned/operated said facility at all times pertinent hereto .

That on November 9, 2006, Gerald E . Steele of the Illinois Environmental Protection
Agency's Marion Regional Office inspected the above-referenced facility . A copy of his inspection
report setting forth the results of said inspection is attached hereto and made a part hereof .
VIOLATIONS
Based upon direct observations made by Gerald E . Steele during the course of his
November 9, 2006 inspection of the above-referenced facility, the Illinois Environmental Protection
Agency has determined that Respondents violated the Illinois Environmental Protection Act
(hereinafter, the "Act") as follows :
(1) That Respondents conducted a sanitary landfill in a manner which resulted in uncovered
refuse remaining from the previous operating day or at the conclusion of any operating
day, a violation of Section 21(o)(5) of the Act, 415 ILCS 5/21
(o)(5) (2004).
(2) That Respondents conducted a sanitary landfill in a manner which resulted in failure to
collect and contain litter by the end of each operating day, a violation of Section
21(o)(12) of the Act, 415 ILCS 5/21 (o)(1 2) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4) of the Act, 415 ILCS 5/42(b)(4) (2004), Respondents are
subject to a civil penalty of Five Hundred Dollars ($500 .00) for each off the violations identified
above, for a total of One Thousand Dollars ($1,000 .00).
If Respondents elect not to petition the
Illinois Pollution Control Board, the statutory civil penalty specified above shall be due and payable
no later than January 30, 2007, unless otherwise provided by order of the Illinois Pollution Control
Board .

If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31 .1 of the Act, 415 ILCS 5/31
.1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, afteran adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board . Those hearing costs shall be assessed
in addition to the statutory civil penalty .
Pursuant to Section 31 .1 (d)(1) of the Act, 415 ILCS 5/31 .1 (d)(1) (2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and a finding of violation as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondents' check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P .O
. Box 19276, Springfield,
Illinois 62794-9276 . Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment
.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received
. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued
.

ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31
.1 of the Act, 415 ILCS 5/31/1 (2004)
. If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601
. A copy of said Petition for Review shall be filed with the Illinois Environmental Protection

Affiant, Gerald E . Steele, being first duly sworn, voluntarily deposes and states as follows :
1 . Aff ant is a field inspector employed by the Land Pollution Control Division of the
Illinois Environmental Protection Agency and has been so employed at all times pertinent hereto .
2 . On November 9, 2006, between 9:45 a.m. and 11 :55 a.m ., Affiant conducted an
inspection of a disposal site operated by Perry Ridge Landfill, located in Perry County, Illinois,
and known as the Perry Ridge Landfill by the Illinois Environmental Protection Agency . Said
site has been assigned site code number #1450105039 by the Agency .
3 . Affiant inspected said Perry Ridge Landfill site by an on-site inspection which
included walking and photographing the site .
4 . As a result of the material actions referred to in paragraph 3 above, Affiant completed
the Inspection Report form attached hereto and made a part hereof, which, to the best of Affiant's
knowledge and belief, is an accurate representation of Affiant's observations and factual
conclusions with respect to said Perry Ridge Landfill .

Subject: Perry Ridge Landfill Inspection
General Remarks
:
On Thursday, November 9, 2006, an inspection was conducted at the Per y
Ridge Landfill
. The inspection was conducted by Gary Steele, IEPA, accompanied by Jason Van
Zandt, Perry County Solid Waste
. We arrived at the landfill at 9:45a.m. The weather was clear and
the temperature was mid 60's . There was no one in the office when we arrived on site . We then
proceeded to the active area of the site . Mr. Whitlock did not accompany us during the inspection of
the landfill
.
South and west of the leachate collection tanks, we observed a large pile of railroad ties that
were being smashed by a track hoe
. They were then loaded onto an off road dump truck, and taken
to the active cell . Adjacent to this was a pile of pallets
. This operation was taking place outside of
the permitted area (Section, 21(d) (1) (2), and 21(e)) .
As we arrived at the active area, trucks were
dumping on the north side of cell 1 phase B
. We observed trucks dumping within approximately 5
yards from a ground water monitoring well (photo 001,002) . This was outside of the permitted area .
Then a bulldozer would push the trash into the permitted area and up the slope (Section, 21(d) (1)
(2), and 21(e)) . That day's active area (Area A on the site sketch) was located in the north central
part of the cell
. West of this was a section that had been covered by the plastic ADC (Area B) . We
observed an area, measuring approximately 10 yards x 25 yards of uncovered refuse on the south
west corner of the upper lift (006,007) adjacent to the ADC (Area C)
. A55 yards x 60 yard area was
observed on the southeast side of cell 1 that had waste protruding through available cover (Area D on
the site sketch) . (Section, 811 .106(a) (b) and 21 (o)(5)).
The western vertical face of the cell was
seen to have been covered with plastic ADC during the 9/11/06 inspection . An approximate 15
yards by 5 foot section at the northern end was observed where the plastic had torn, exposing refuse
(Area E)(Section 21
(o)(5), and 811
.106(a)(b)) . Scattered waste was also observed on the south side
of the slope in phase 1 . It was observed that the waste was exposed from erosion and lack of daily
cover. This area (Area F) was approximately 70 yards x 20 yards (019)
. We also observed litter over
the north and south slopes, and over the new cell west of the permitted area (photo 1,2,4,5,8,9,&10)
.
The wind was from the south. There were no litter fences seen on site
.
Also observed was the leachate pump control switch
. It was set in the off position (020) .
The leachate collection system indicator had a reading of -34 .2 .
It was observed that the water
retention pond was nearly dry and the storm water control system look to be in good order
. New
monitoring wells had been installed along the retention pond and western boundary of the site
.
While they were outfitted with lockable metal covers, they did not have any protective poles around
them.
At the end of the inspection we met with Mr
. Whitlock the certified operator of the Perry
Ridge Landfill . At this time we reviewed the records
. The load checking and alternate daily cover
records were in order. Photographs taken of the loads checked showed they were last in the vicinity
of Area D on October 20, 2006
. Mr. Whitlock confirmed it had been since the last week in October
that they had bee in this section . The records also showed that no special waste had been accepted
since the last inspection . Leachate records showed that leachate was last hauled November 11, 2005
.
Mr. Whitlock said that they would be hauling the leachate
. He said they were just waiting on license
for the trucks . They had just received the special waste hauling permit for A-1 Environmental
Services. A truck lettered as this was parked near the office . We asked about the leachate pump
being turned off . He said he turns it off every night, so the tanks aren't overtopped while no one is
there
. He said it had not been turned on this morning as it had blown a fuse, and he had not replaced
it . Water was ponded in the newly constructed cell
; including areas that had not received a sand
drainage layer (photos 4,5,6,9,10,14, & 17)
. The inspection ended at 11 :55a .m.
The following conditions, which constitute violations, were observed
:
Line 7 & 8 ; Conducting a waste disposal operation in violation of permit requirements, and contrary
to Board Regulations : Conditions were observed that were not in accordance with the permit issued
to this site . Specifically, landfill operations were occurring outside of the permitted operating area
.
The leachate pump was inoperable, new monitoring wells were not equipped with protective posts
.
Daily cover had not been applied as per Board Regulations . Litter was not being controlled or
collected as per Board Regulations .
Line 10 (5) and Line 29 ; Uncovered refuse and daily cover
; Refuse was observed exposed and or
protruding through available cover in Areas C, D, E, & F
.
Line 10 (12) and Line 30 (k) ; Failure to collect and contain litter and litter control : Litter was
observed scattered over the north, south and western portions of the landfill, including the slopes of
the filled area. The wind was from the south, and that day's active area was on the north central
slope. No litter control fences were seen .
