FACTS
1 .
That C. John Blickhan ("Respondent") is the present operator of a facility located at
Lock and Dam Road, Quincy, Adams County, Illinois
. The property is commonly known to the
Illinois Environmental Protection Agency as Quincy/Blickhan Landfill
.
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No
. 0010650002 .
3.
That Respondent has owned and operated said facility at all times pertinent hereto .

That on September 20, 2006, Paul Eisenbrandt of the Illinois Environmental
Protection Agency's Springfield Regional Office inspected the above-described facility
. A copy of
his inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.

 
VIOLATIONS
Based upon direct observations made by Paul Eisenbrandt during the course of his
September 20, 2006 inspection of the above-named facility, the Illinois Environmental Protection
Agency has determined that Respondent has violated the Illinois Environmental Protection Act
(hereinafter, the "Act") as follows :
(1)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004) .
(2)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21 (p)(3) (2004).
(3)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in deposition of general construction or demolition debris or clean
construction or demolition debris, a violation of Section 21
(p)(7) of the Act, 415 ILCS
5/21 (p)(7) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondent is
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500
.00) for each of the
violations identified above, for a total of
Four Thousand Five Hundred Dollars ($4,500 .00).
If
Respondent elects not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified above shall be due and payable no later than
November 30, 2006,
unless otherwise
provided by order of the Illinois Pollution Control Board
.

If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31
.1 of the Act, 415 ILCS 5/31
.1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board
. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500
.00) statutory civil penalty for each
violation .
Pursuant to Section 31 .1 (d)(1)
of the Act, 415 ILCS 5/31 .1 (d)(1) (2004), if Respondent fails
to petition or elects not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondent's check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P
.O. Box 19276, Springfield,
Illinois 62794-9276
. Along with payment, Respondent shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment .
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondent from the date payment is due up to and including the date that payment is
received
. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

Respondent has the right to contest this Administrative Citation pursuant to and in
accordance with Section 31
.1 of the Act, 415 ILCS 5/31/1 (2004). If Respondent elects to contest

Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois

The purpose of this memorandum is to serve as the Narrative Inspection Report Document of a
September 20, 2006 landfill inspection at the above referenced site
. The inspection took place
from approximately 10
:40 am to 12:40 pm, and thirty-five (35) digital photographs were taken .
The weather at the time of the inspection was sunny and about 82 °F. Mr. C. John Blickhan was
interviewed during the inspection
.
The applicable permit at the time of the inspection was Supplemental Permit No
. 2004-182-SP .
The fifteen year minimum post-closure care period began on September 30, 1992
. Six permitted
groundwater-monitoring wells are at the site
. Well R101 is permitted as upgradient . Wells
G103, G104, G105, G106, and G107 are permitted as downgradient locations
.
Photograph 001 shows the main entrance to Blinkhan Landfill . The gate to the landfill (Site No .
1) is located west of the office and maintenance buildings, and at the end of the access road .
Photograph 002 shows the northeast corner of Site No . 2. No stressed vegetation, rills, or
leachate seeps were observed from Lock and Dam Road
.
Photographs 003, 004, and 005 show the northeast and west sections of Site No .1, respectively .
No areas of concern were identified from Lock and Dam Road .
Photograph 006 shows a large burn pile located behind House No . 6 in Blick's Village (as visible
from Lock and Dam Road) . Smoke was observed rising from the burn pile .
Photograph 007 shows burning garbage, construction debris, miscellaneous waste, and landscape
debris behind House No . 6
. Michael Lish, resident of House No . 6 for the past 1-1/2 months
claimed he did not know he could not burn the garbage . Mr. Lish stated his address was 2000
Blick's Village Court, House No
. 6 in Quincy, Illinois . Mr. Lish claimed he did not have a
phone
. He also stated he has no garbage service nor does anybody else in Blick's Village . Mr.
Lish was instructed to extinguish the fire while the Illinois EPA inspector was on site . The

environmental regulations concerning open burning were discussed with Mr . Lish. He stated he
would no longer burn trash .
Photographs 8, 9, 10, and 11 show the large burn pile smoldering on a circular concrete pad
behind House No . 6. There was approximately four cubic yards of waste on site . The charred
waste included grass clippings, a mattress, asphalt shingles, plastic bottles, used paint supplies,
alcohol bottles, an aluminum gutter, a toaster oven, a vanity mirror, aluminum cans, a VCR tape,
screen material, paint cans, melted plastic, scrap metal, grey carpet, vinyl flooring, nails, an
aerosol insecticide can, paint rollers, plastic food wrappers, fast food packaging, and
miscellaneous charred wood, waste, and ash .
Photograph 012 shows a pile of open-dumped waste behind House No . 1 .
The Illinois EPA inspector arrived at Blick's Construction office and met Ms . Lori Graupman
and John Blickhan
. Mr. Blickhan agreed to unlock the gate that leads to Site No . I while the
Illinois EPA inspector started the inspection on Site No . 2 .
The Illinois EPA inspector informed Mr . Blickhan of the open burning and open dumping
violations that were observed at Blick's Village . Mr. Blickhan claimed he had told his tenants
not to burn
. The inspector explained to Mr . Blickhan that he was responsible since he owned the
property
. The inspector suggested the landlord (Mr . Blickhan) force each tenant to have garbage
pick up or to provide a central dumpster for all the tenants to use . Mr. Blickhan left to conduct
business and investigate the open burning and open dumping violations for himself .
Photographs 013 and 014 show groundwater monitoring well G103 . This well is located on the
northeast corner of Site No
. 2 . The Illinois EPA inspector cleared away some of the weeds to
examine the well
. The well was properly locked, clearly labeled, had adequate drainage around
the well, had a drain hole in the bottom of the protective casing, and had a good surface seal .
None of the wells were opened during the inspection so the well casings and well caps were not
inspected.
Photographs 015 and 016 show the northern and western edges of Site No . 2 . The vegetation
was well established and there were no areas of stressed or dead vegetation . There were no rills,
bare soil, or low spots collecting water on Site No . 2 .
Photographs 017, 018, and 019 were exposed from the western edge of the landfill . Photograph
017 shows a pile of landscape waste and garbage burning behind house No . 3 in Blick's Village.
The burn pile was smoldering while the Illinois EPA inspector was conducting the landfill
inspection
. Photographs 018 and 019 show two small piles of garbage behind House No . 2. The
northern debris pile contained landscape waste and household garbage setting on charred waste
and ash . The southern debris pile at House No . 2 appeared to be household waste dumped in the
grass. Waste at this second location did not appear to have been burnt .
Photograph 020 shows groundwater monitoring well G 106 . This well is located on the south side
of Site No
. 2 and on the north side of an access road . The well was properly locked, clearly
labeled, had adequate drainage around the well, had a drain hole in the bottom of the protective

casing, and had a good surface seal
. A metal pipe marking the location of the well was broken
off the corner of the surface seal
. The metal pipe still lay beside the well . The integrity of the
surface seal was not compromised .
Photograph 021 shows the southeast face of Site No
. 2. The gated entrance can be seen in the
background of the picture . The entrance appeared to be properly secured .
Photograph 022 shows the top of Site No . 2. The drainage off the top of the landfill appeared to
be adequate . The grassy vegetation was well established . No debris was observed near or on the
filled area .
Photographs 023 and 024 show the western edge of construction fill area . Blick's Construction
is dumping fill material and leveling off the surface . Several piles of concrete, brick, and mixed
stone can be seen in the background of the photograph
. The area in the foreground was filled and
leveled off within the last two years .
Photographs 025 and 026 show the central and eastern edge of the construction fill area . This
older fill area was void of debris .
Photographs 027 and 028 show groundwater monitoring well RI01
. This replacement well is
located on the northeast corner of the Site No
.1 . The well was properly locked, clearly labeled,
had adequate drainage around the well, had a drain hole in the bottom of the protective casing,
and had a good surface seal .
Photographs 029 and 030 show groundwater monitoring well G 104
. The vegetation has grown
up around the well . The Illinois EPA inspector cleared away some of the weeds to perform the
inspection. Well G104 is near the southwest corner of Site No
. 1 . The well was properly locked,
clearly labeled, had adequate drainage around the well, had a drain hole in the bottom of the
protective casing, and had a good surface seal .
Photograph 031 and 032 show groundwater monitoring well G105 . Some weedy vegetation had
grown up around this well . The weeds were cleared away
. The well was properly locked, clearly
labeled, had adequate drainage around the well, had a drain hole in the bottom of the protective
casing, and had a good surface seal .
Photograph 033 and 034 show groundwater monitoring well G 107 . Thick vegetation had
partially covered this well . The inspection was conducted after some of the vegetation was
removed. The well was properly locked, clearly labeled, had adequate drainage around the well,
had a drain hole in the bottom of the protective casing, and had a good surface seal .
Photograph 035 shows the base of the steel protective casing and part of the concrete surface
seal . Vegetation was observed growing between the surface seal and the protective casing . The
vegetation must be removed before the well is damaged .
After the inspection, the inspector stopped back by the Blick's Construction office . Mr. Blickhan
was not there . The Illinois EPA inspector informed Ms
. Graupman the landfill looked good

except for the open burning and open dumping situation at Blick's Village . The Illinois EPA
inspector offered a two week window opportunity for the waste at Blick's Village to be cleaned
up prior to enforcement actions . As a condition of the clean-up, photographic proof and copies
of waste disposal receipts would need to be received, by the Illinois EPA, within two weeks of
the inspection . The two week window opportunity would expire on October 4, 2006
. Ms .
Graupman believed Mr
. Blickhan would seize the opportunity and have the waste removed
immediately .
With review of their Supplemental Permit No
. 2004-182-SP the Illinois EPA inspector noticed
the facility is out of compliance with Condition 5
. Condition 5 reads :
The operator shall file a revised cost estimate for post-closure care at least every two
years in accordance with 35 Ill. Adm . Code, Subtitle G, Part 807, Subpart F
. The next
revised cost estimate is due by June 1, 2006 . The revised cost estimate is to be submitted
to the Illinois EPA as an application for supplemental permit .
The Illinois EPA inspector contacted Ms
. Tressa Prior, Administrative Support Staff for
BOL/Permits on October 4, 2006. There is no record of Blickhan Landfill submitting the
supplemental application in the data base or in the processing center
. To date, the operator has
not submitted the post-closure care cost estimate pursuant to Condition 5
. A violation notice
should be issued
.
On October 5, 2006 the Illinois EPA inspector checked the mail processing station at the
Springfield Regional Office and confirmed the required document from Mr . Blickhan, that was
due to the inspector by Oct 4, 2006, did not arrive
. The two week window of opportunity to
clean up the waste has expired
. Approximately 20 cubic yards of on-site generated waste was
observed on September 20, 2006 . An administrative citation should be issued .
The apparent violations are indicated on the attached landfill inspection checklist, the open dump
inspection checklist . A site sketch and digital photographs accompany this narrative.
