HEARING OFFICER ORDER
Background
On February 7, 2006, ExxonMobil Oil Corporation (ExxonMobil) filed a proposal for
rulemaking pursuant to Section 28 of the Environmental Protection Act (Act) (415 ILCS 28
(2004)), to authorize discharges of Total Dissolved Solids (TDS) from its Joliet Refinery during
the months of November through April
. The discharge point of the Joliet Refinery is located at
Interstate 55 and Arsenal Road, in Will County
. ExxonMobil also filed a joint motion with the
Illinois Environmental Protection Agency (Agency) to expedite consideration
.
On March 2, 2006, the Board adopted the proposed amendments for the purpose of first
notice under the Illinois Administrative Procedure Act (APA) (5 ILCS 100/1-1) without
commenting on the merits of the proposal, and granted the motion for expedited consideration
.
On March 2, 2006, the Board sent a letter to Jack Lavin, Director of the Department of
Commerce and Economic Opportunity (DCEO), requesting an economic impact study on this
rule
. In the letter, the Board asked the DCEO to respond by April 1, 2006
. To date, no response
to the request has been received by the Board
. The Board's letter requesting an economic impact
study has been available to the public at the Board's Chicago office and online since March 2,
2006.
Hearing
Persons wishing to testify at the hearing must prefile their testimony and any related
exhibits with the Board and serve the hearing officer and all persons on the service list
no later
than May 31, 2006
. Persons may receive a copy of the service list by contacting the hearing

.
The parties are directed to participate in a final pre-hearing telephone status conference
on June 7, 2006, at 2
:00 p.m
. The petitioner shall initiate the call
. At that time, the parties must
