HEARING OFFICER ORDER
On May 25, 2006, the Board held its first hearing in this rulemaking proceeding . In the
course of that first hearing, witnesses for the Illinois Environmental Protection Agency (Agency)
sought to respond to specific questions by preparing responses for the second hearing, which is
now scheduled to take place Thursday, June 29, 2006 in Chicago . The hearing transcript, which
is expected to be available on or about Tuesday, June 6, 2006, will reveal the substance of those
questions for which the Agency sought to prepare responses for the second hearing
.
After discussing procedural issues with them, the hearing participants accepted a deadline
of Thursday, June 15, 2006 for the filing of those responses
. Consequently, the Agency is
directed to file by June 15, 2006 and in the form of a public comment its responses to those
questions for which it sought to prepare responses for the second hearing . Because this deadline
falls only 14 days before the date of the second hearing, the "mailbox rule" at 35 111 . Adm
. Code
101 .300(b)(2) does not apply and the Clerk must receive these documents on June 15, 2006
.
However, this particular public comment and other documents may be filed electronically though
the Clerk's Office On-Line (COOL) from the Board's Web site at www.ipcb .state

The second hearing will continue to take place as schedule on June 29, 2006 at 1 :00 PM
