The second hearing in this proceeding took place Thursday, June 29th in Chicago

. On

Friday July 14, 2006, the Board received the transcript of that hearing and posted it to its Web

site at

www .ipcb.state.il .us. Under section 102

.108(b) of the Board's procedural rules, "[a]ny

person may submit written comments on any proposal within 14 days after the receipt of the

hearing transcript in Board offices unless otherwise specified by the hearing officer or the

Board." 35 Ill . Adm. Code 102

.108(b) . Accordingly, the Board may receive comments on this

proposed rule filed on or before Friday, July 28, 2006

. In the event that the Board issues a

proposal for first notice, the Board's procedural rules provide for an additional period of public

comment . See 35 Ill . Adm . Code 102 .108(a), 102

.604 .

At the second hearing on June 29, 2006, NORA and the Illinois Environmental Protection

Agency agreed to a deadline of Wednesday, August 9, 2006 for the filing of post-hearing

comments . The "mailbox rule" at 35 Ill

. Adm. Code 101

.300(b)(2) does not apply to the filing

of these post-hearing comments, and the Clerk must receive these documents on or before the

close of business on August 9, 2006

. Comments and other documents may be filed

electronically through the Clerk's Office On-Line (COOL) from the Board's Web site at

www.ipcb.state.il
