Dear Chairman Girard :

Thank you for your January 10, 2006 letter requesting the Department of Commerce and

Economic Opportunity ("Department") to conduct an economic impact study concerning Illinois

Environmental Protection Agency's (EPA) proposal to add a new Part to the Board's regulations

governing the use of clean construction or demolition debris as fill material in current and former

quarries, mines, and other excavations .

The Department has reviewed the Board's request for an Economic Impact Study for

EPA's proposal . Based on this review, and in light of continued fiscal constraints, the

Department has decided not to conduct a study of the economic impact of the above referenced

rulemaking proposal .
