HEARING OFFICER ORDER
As set forth below, this order establishes a pre-first notice deadline for filing public
comments with the Board
. By way of background, on April 19, 2004, the Board received a
rulemaking proposal from the Illinois Association of Wastewater Agencies (JAWA)
. IAWA
seeks to amend the Board's rule establishing general use water quality standards for dissolved
oxygen (35 Ill . Adm
. Code 302 .206)
. On April 4, 2006, the Illinois Environmental Protection
Agency and the Illinois Department of Natural Resources filed a joint proposal to amend the
general use water quality standards for dissolved oxygen
.
The Board has held five hearings in this rulemaking
: June 29, 2004 in Chicago ;
August 12, 2004 in Springfield
; August 25, 2005 in Chicago
; April 25, 2006 in Springfield ; and
November 2-3, 2006 in Springfield
. December 20, 2006 is the deadline for filing written public
comments with the Clerk's Office before the Board proceeds to first notice
. As discussed at the
end of the fifth hearing, if the Board proceeds to first notice, there will be other opportunities to
file public comments in this rulemaking
. Filing by December 20, 2006, however, ensures that
your comment will be considered by the Board before the Board adopts any proposed
amendments for first-notice publication in the Illinois
Register .
