Proposed Rule. Dismissal Order.

ORDER OF THE BOARD (by G.T. Girard):

Pursuant to Section 22.40(a) of the Environmental Protection Act (415 ILCS

5/22.40(a) (1996)), the Board would normally propose amendments to the Illinois regulations

that are identical-in-substance with the United States Environmental Protection Agency

(USEPA) amendments to the municipal solid waste landfill (MSWLF) rules adopted pursuant

to Sections 4004 and 4010 of Subtitle D of the Resource Conservation and Recover Act, as

amended. 42 U.S.C. §§ 6944, 6949(a) (1976)

.

USEPA has codified its MSWLF regulations

at 40 CFR 257 through 258. The term identical-in-substance has been defined in Section 7.2

of the Act (415 ILCS 5/7.2 (1996)). Accordingly, the Board reserved this docket for USEPA

amendments during the period from January 1, 1997 through June 30, 1997. However,

USEPA did not amend its MSWLF regulations during this period.

For the foregoing reasons, the Board hereby dismisses this proceeding and closes this

docket.
