ORDER OF THE BOARD (by J. Anderson):
Section 9.1(e) of the Environmental Protection Act (Act)
requires the Board to adopt exemptions from the definition of
volatile organic material (VOM) which are “identical in
substance” with USEPA exemptions originally, adopted pursuant to
its “Recommended Policy on the Control of Volatile Organic
Compounds”, and now codified as 40 CFR 51.100(s).
Accordingly, the Board reserved this docket for USEPA amendments
during the period from January 1 through June 30, 1992.
USEPA amended its recommended policy to the extent it
codified this policy effective March 4, 1992. (57 Fed. Reg. 3941
(Feb. 3, 1992)). This rulemaking became the subject of the
amendments of July 23, 1992 in docket R91-24. No other revisions
to the federal definition or federal policy occurred during this
update period.
For the foregoing reason, the Board hereby dismisses this
proceeding.
