ORDER OF THE BOARD (by Mr. Durnelle):
Since the Petition for Amendments to the Water Pollution
Regulations, filed February 2, 1976, does not contain 200 or
more signatures, its proposal by the Board is wholly discretionary
with the Board. On February 19, 1976 the Board requested the
Environmental Protection Agency to review the subject Petition
and advise the Board whether sufficient merit exists for (a)
the Agency to propose the Petition as a regulation under its
own authority or (b) the Agency to recommend that the Board do
so. The Agency filed its response on March 25, 1976, advising
the Board that the Agency would not propose the Petition as its
own. The Agency further recommended that the Board not propose
the Petition under its own authority. Additionally, the Agency
does not at present have the manpower and resources to apply
extensive technical input into the matter. Since the Petition
contains material with which the Board is not fully familiar,
the Board chooses not to propose the requested regulation
for public hearings.
The Petition is dismissed without prejudice.
