R 73-11 & R 73-12

ORDER OF THE BOARD (by Mr. Goodman):

On September 30, 1976, the Board proposed to amend the adopting

Order in R 73-11 and R 73-12 to the extent that Rule 410(c) of

Chapter 3, Water Pollution Regulations, be made effective immediately.

The Board authorized publication of its proposed amendment in the

Environmental Register for the purpose of public comment. The public

comment period was to run until November 15, 1976.

The proposed amendment was published in Environmental Register

#135. The Board has received no public comment. We, therefore,

amend the adopting Order in R 73-11 and R 73-12 to the extent that

Rule 410(c) is hereby made effective as of the date of this Order.

For clarification, Rule 410(c) shall be amended to read:

(c) The standards of Chapter 3 shall apply to

thermal discharges unless, after public notice

and opportunity for public hearing, in accord-

ance with Section 316 of the FWPCA and applic-

able federal regulations, the Administrator

and the Board have determined that different

standards shall apply to a particular thermal

discharge. This Rule 410(c) shall be effective

as of December 16, 1976.
