JURISDICTION
This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1
et. seq.
(2004) and delegated to Ogle County
pursuant to 415 ILCS 5/4 (r) and 415 ILCS 5/31.1.
FACTS
1.
That Respondent, Veolia ES Orchard Hills Landfill, Inc., is the present operator of a
facility located at 8290 Highway 251, Davis Junction, Illinois, in the County of Ogle,
State of Illinois.
2.
That said facility is operated as a sanitary landfill, operating under Illinois Environmental
Protection Agency Operating Permit No. 1996-135-LF, and designated with Site Code
No. 1410175005.
3.
That Respondent has owned or operated said facility at all times pertinent hereto.
4.
That on July 28, 2008, Joy K. Bliton, of the Ogle County Solid Waste Management
Department, inspected the above-described landfill facility. A copy of the inspection
report setting forth the results of such inspection is attached hereto and made a part
hereof.

VIOLATIONS
On the basis of direct observation by Joy K. Bliton, the County of Ogle has determined
that Respondent was conducting a sanitary landfill operation at the above-described facility,
which is required to have a permit pursuant to 415 ILCS 5/21(d), in a manner which resulted in
the following conditions:
A.
That on July 28, 2008, an on-site inspection of said sanitary landfill facility, and
review of Illinois Environmental Protection Agency files and records of said
facility, disclosed the following:
1.
Uncovered refuse remaining from a previous operating day, in violation of
415 ILCS 5/21(o)(5).
This violation was noted due to the piles of uncovered waste on the north side of
the road within Phase VI. The waste had resulted from making pockets into the
waste for drainage of ponded water. The waste remained uncovered since July
23, 2008.
CIVIL PENALTY
Pursuant to 415 ILCS 5/42(b)(4), Respondent herein is subject to a civil penalty of Five
Hundred Dollars ($500.00) for each violation specified above in Paragraph A, for a total of Five
Hundred Dollars ($500.00). Additionally, should Respondent elect to petition the Illinois
Pollution Control Board under the review process described herein below, and if there is a
finding of the violations alleged herein, after an adjudicatory hearing, Respondent shall be
assessed the associated hearing costs incurred by Ogle County and the Illinois Pollution Control
Board, in addition to the Five Hundred Dollar ($500.00) statutory penalty for each finding of
violation. If Respondent acknowledges the violation cited hereinabove, the civil penalty
specified above shall be due and payable no later than thirty-five (35) days from the date of
service hereof. If Respondent does not petition the Illinois Pollution Control Board for review of
this Administrative Citation within thirty-five (35) days of service hereof or if Respondent elects

to contest this Administrative Citation, any judgment rendered against Respondent shall
specify the due date of the statutory civil penalty and any costs assessed against
Respondent.
When payment is made, checks shall be made payable in equal amounts ($250, or
50%, of the total penalty each) to:
(1)
Illinois Environmental Protection Trust Fund and mailed to the attention
of Fiscal Services, Illinois Environmental Protection Agency, 1021 North Grand Avenue
East, P.O. Box 19276, Springfield, Illinois 62794-9276; and
(2)
Ogle County Treasurer, Ogle County Courthouse, P.O. Box 40, Oregon,
IL 61061.
If any civil penalty, by reason of acknowledgment, default or finding after
adjudicatory hearing, is not paid when due, the Illinois Environmental Protection Agency
shall take into consideration such failure to pay during any permit review process upon
Respondent’s application for a new permit or for renewal of an existing permit. If any
civil penalty imposed by the Illinois Pollution Control Board is not paid within the time
prescribed in the order, interest on such penalty will be assessed for the period from the
date payment is due until the date payment is received. Furthermore, if payment is not
received when due, the Ogle County State’s Attorney shall be requested to initiate
proceedings in Circuit Court to collect said civil penalty. In addition to the previously
assessed civil penalty, interest, and hearing costs of Ogle County and the Illinois
Pollution Control Board, if any, the Ogle County State’s Attorney will seek to recover
their costs of litigation.

PROCEDURE FOR CONTESTING THIS ADMINISTRATIVE CITATION
Respondent has the right to contest this Administrative Citation (

5/31.1). If Respondent elects to contest this Administrative Citation, Respondent must
file a Petition for Review with the Clerk of the Illinois Pollution Control Board. A copy
of the Petition for Review should also be filed with the Ogle County State’s Attorney’s
Office.
Such Petition for Review must be filed within thirty-five (35) days of the
date of service of this Administrative Citation, or a default judgment against
Respondent shall be entered by the Pollution Control Board.
The original Petition for
Review must be filed with the Clerk of the Illinois Pollution Control Board at the James
R. Thompson Center, 100 West Randolph, Suite 11-500, Chicago, Illinois 60601, and; a
copy of said Petition for Review must be filed with the Ogle County State’s Attorney’s

I arrived at the Orchard Hills Landfill at 11:40 am. I walked up to the scale
house. I could smell an odor from landscape waste. Ashley, the scale house
operator, called Gary LaBorde who drove to meet me. Gary and I drove over to
the working face.
The working face is located in Phase VI. As we drove toward the working face, I
noted piles of waste on the north side of the road. I inquired of Gary as to why
they were there. He said that rainwater had been ponding up there so they opened
up the waste in 3 pockets last Wednesday, July 23, 2008, to allow the water to
sink in. I noted a few tires on the slope also. We drove up to the working face.
Two tippers were being used. A load of processed landscape waste from Midwest
was unloading nearby to the working face. Midwest is the same as American
Wood Recycling. Gary said that Midwest is using an odor suppressant and
mixing it in with the yard waste. He also said that they have been adding
“Agricare” to their water trucks to help eliminate odors. He said the water trucks
will drive over flat areas within the cells and spray. He said that they have used it
in the past and that it worked pretty well then, so they thought that they would try
it again. They have been using it for about one month and Gary thought it seemed
to be working pretty well.
We got out of the truck and walked around the area where they dug pockets into
the waste for drainage. I explained to Gary that the waste needs to be covered
with dirt or tarps and not allow it to be exposed. We continued to walk the area
north of the road. There were a number of tires laying about. Gary pulled two
full tires out of the waste. Gary said that the last time they graded this area was
about 1 ½ weeks ago. I told Gary that tires should be picked up and hauled to a
separate location for recycling.
We walked to the south side of the road and overlooked the south slope of Phase
VI. The stormwater retention pond is just south of this cell in future Phase VIII.
Due to recent rains this south slope had many deep erosion gullies. There used to
be a berm at the bottom of the slope so that the water running down the slope ran
back into the cell and was treated as leachate. However, the berm has recently

been removed and now the water runs down into the stormwater retention pond.
This would be alright as long as the intermediate dirt cover is at least one (1) foot
thick to prevent water from coming into contact with waste on its way to the
retention pond. With the exposed waste on the slope, the stormwater comes into
contact with the waste, runs across a leveled area and down into the stormwater
retention pond. This water had been pumped to the drainage ditch that leads to
the sedimentation basin on the northwest corner of the site, although it wasn’t
being pumped presently. The water in the stormwater retention pond needs to be
treated as leachate. I discussed these concerns with Gary. In addition, the water
in the sedimentation basin should be tested before discharging to waters of the
State. I noted one erosion gully that was stained orange. Gary said that they last
graded the area about 4 weeks ago.
We walked back to the truck and drove west. The berm that had been leveled out
on the east side of Phase VI was still in place on the west side of Phase VI, which
is just south of the working face. In this area, the stormwater that is in contact
with the waste is treated as leachate, as it should be.
We continued driving west and drove over to the construction of Phase VII. The
roadway runs east-west through the cell. On the north side of Phase VII, they are
putting the clay liner in. The clay liner looked very dry. On the south side they
are using scrappers to get down to subgrade. They no longer use cut stakes but
use GPS instead. Gary said they will leave the road in as long as they can.
We headed back to the scale house and discussed the concerns I had today:
buried tires, exposed waste, and erosion allowing leachate to run into the
stormwater retention pond. I asked Gary if he had the load checking records. He
said he could get them. I asked him if he could have them available for me to
look through on July 30, 2008 when I stop by to pick up information regarding the
well water protection plan. He said he could.
A Waste Management truck had a fire on top of his truck before the truck reached
the scale house, Gary responded to that. The fire was put out by the driver and it
did not appear to be a concern.
I then left the site at 1:25pm.
On July 30, I arrived at the Orchard Hills Landfill at 10:22 am. I stopped at the
scale house and then proceeded to the office, where I met Chris Peters. Chris
gave me a copy of their well water protection plan. We discussed the plan. He
also gave me the load checking records from 2007 and 2008. I examined the
records from January 3, 2007 through July 22, 2008 and recorded the dates that
load checking was performed. I noted a gap between the dates of April 17, 2007
and May 12, 2007 where there were no records indicating that any load checking
was performed. I discussed this with Chris. He said he would look into it to see
if they have the records. I left the office at 11:19am.

On August 6, 2008, Chris Peters called. He apologized for not getting back to me
sooner. He said that he was sure that the random load inspections were all
completed. However, he stated that there was a two-week period (the weeks of
April 23, 2007 and April 30, 2007) in which the reports for the six inspections
during that two week period were inadvertently misplaced.
Violations of 415 ILCS 5/21(o)
On the basis of direct observation by Joy K. Bliton, the County of Ogle has
determined that Respondent was conducting a sanitary landfill operation at the above-
described facility, which is required to have a permit pursuant to 415 ILCS 5/21(d), in a
manner which resulted in the following conditions:
A. That on July 28, 2008, an on-site inspection of said sanitary landfill
facility, and review of Illinois Environmental Protection Agency files
and records of said facility, disclosed the following:
1. Uncovered refuse remaining from a previous operating day, in
violation of 415 ILCS 5/21(o)(5).
This violation was noted due to the piles of uncovered waste on the north
side of the road within Phase VI. The waste had resulted from making
pockets into the waste for drainage of ponded water. The waste remained
uncovered since July 23, 2008.
Other Violations
Although not subject to 415 ILCS 5/21(o), other violations were noted:
1. Causing or threatening or allowing the discharge of any contaminants into the
environment in any state so as to cause or tend to cause water pollution in Illinois,
in violation of 415 ILCS 5/12(a).
This violation was noted because stormwater came into contact with uncovered
waste along the south slope of Phase VI and ran into the stormwater retention
pond. The water in the stormwater retention pond is pumped to the ditch along
the east side of the cell and drains into the sedimentation basin. The water in the
sedimentation basin is discharged to the existing drainage channel.
2. Depositing any contaminants upon the land in such place and manner so as to
create a water pollution hazard in violation of 415 ILCS 5/12(d).

3. Causing, threatening, or allowing the discharge of any contaminant into the
waters of the State in violation of an NPDES permit in violation of 415 ILCS
5/12(f).
Please see #1 as to the explanation of this violation.
4. Conducting any waste storage, waste treatment, or waste disposal operation in
violation of any conditions of a permit, in violation of 415 ILCS 5/21(d)(1).
This violation was noted due to violations of Permit 1996-135-LF, mod. # 46,
II.3, II.5, II.8, II.9, II.11, IV.2, and IV.6.
5. Conducting any waste storage, waste treatment, or waste disposal operation in
violation of any regulations or standards adopted by the Board under this
Environmental Protection Act in violation of 415 ILCS 5/21 (d)(2).
This violation was noted due to the violation of 35 Ill. Adm. Code 811.103(a),
811.112(b), 811.313(a), 811.313(c) and 811.323(c).
6. Disposing, treating, storing or abandoning any waste or transporting any waste
into the state at/to sites not meeting requirements of Act and of regulations in
violation of 415 ILCS 5/21(e).
This violation was noted due to the violations of 415 ILCS 5/12(a)(d) and(f),
5/21(d)(1) and(2), 5/21(o)(5), 5/55(6)(1), and 35 Ill. Adm. Code 811.103(a),
811.112(b), 811.313(a), 811.313(c) and 811.323(c).
7. Acceptance of any used or waste tire for final disposal in violation of 415 ILCS
5/55(b)(1).
This violation was noted due to the partial burial of tires at the landfill.
8. Discharging to waters of the State runoff from disturbed areas resulting from
precipitation events less than or equal to the 25-year, 24-hour precipitation event
in violation of 35 Ill. Adm. Code 811.103(a)(1).

9. Discharging to waters of the State runoff from disturbed areas that are not
permitted by the Agency in accordance with 35 Ill. Adm. Code 309, in violation
of 35 Ill. Adm. Code 811.103(a)(2).
Please see #1 as to the explanation of this violation.
10. Not recording and retaining near the facility all load checking inspections, in
violation of 35 Ill. Adm. Code 811.112(b).
This violation was noted because there was a gap in the load checking records
between the dates of April 17, 2007 and May 12, 2007, where there were no

records indicating that any load checking was performed. Two weeks (the weeks
of April 23, 2007 and April 30, 2007) were not accounted for.
11. All waste which is not to be covered within 60 days of placement by another lift
of waste or final cover in accordance with 35 Ill. Adm. Code 811.314 did not have
a cover equivalent to that provided by one (1) foot of compacted clean soil
material, in violation of 35 Ill. Adm. Code 811.313(a).
This violation was noted because of the exposed waste on the south slope of
Phase VI.
12. The grade and thickness of intermediate cover was not maintained until the
placement of additional waste or the final cover. All cracks, rills, gullies, and
depressions shall be repaired to prevent access to the solid waste by vectors, to
minimize infiltration and to prevent standing water, in violation of 35 Ill. Adm.
Code 811.313(c).
This violation was noted because of the erosion gullies and lack of thickness of
intermediate cover on the south slope of Phase VI.
13. The load checking program did not consist of an inspection examining at least
three random loads of solid waste delivered to the landfill on a random day each
week, in violation of 35 Ill. Adm. Code 811.323 (c)(a).

14. Conducting the operation of this solid waste facility in a manner which resulted in
uncovered refuse remaining from any previous operating day, in violation of
Permit 1996-135-LF, mod. #46, condition II.3.
This violation was noted due to the piles of uncovered waste on the north side of
the road within Phase VI. The waste had resulted from making pockets into the
waste for drainage of ponded water. The waste remained uncovered since July
23, 2008.
15. Not covering all exposed waste by the end of the operating day with clean soil at
least 6 inches thick or an alternate daily cover material (ADCM) specified in the
permit, in violation of Permit 1996-135-LF, mod. #46, condition II.5.

16. All waste not covered within sixty (60) days of placement with additional waste
or final cover shall have an intermediate cover applied to it. The intermediate
cover shall either be compacted clean soil with minimum thickness of one (1) foot
or alternate intermediate cover applied in accordance with the requirements of
condition Nos. 11.29 and 11.30 of Permit 1996-135-LF, mod. #46. Intermediate
cover was not applied in accordance with the requirements of Permit 1996-135-
LF, in violation of Permit 1996-135-LF, mod. #46, condition II.8.

17. Not implementing a load checking program that meets the requirements of 35 Ill.
Adm. Code, 811.323, in violation of Permit 1996-135-LF, mod. #46, condition
II.9.

18. Tires were found to be mixed with municipal waste and were not managed in
accordance with 35 Ill. Adm. Code Part 848, in violation of Permit 1996-135-LF,
mod. #46, condition II.11.
This violation, as stated in #7, was noted due to the partial burial of tires at the
landfill.
19. Information and observation derived from load checking inspections were not
recorded in writing or retained at the facility for at least (3) years, in violation of
Permit 1996-135-LF, mod. #46, condition IV.2.

records required by 35 Ill. Adm. Code, 811.323, in violation of Permit 1996-135-

have an intermediate cover applied to it. The intermediate cover shall either be compacted clean
