HEARING OFFICER ORDER
On August 11, 2008, the rulemaking proponent, the Illinois Environmental Protection
Agency, filed a motion to correct the transcript of this proceeding's second hearing, which was
held in Springfield on July 16, 2008. No response has been filed to the motion, which is granted.
On the record at the second hearing, the hearing officer set a pre-first notice deadline of
September 12, 2008, for filing public comments. If the Board proceeds to first notice, there will
be other opportunities to file public comments in this rulemaking. Filing by September 12, 2008,
however, ensures that the comment will be considered by the Board before the Board adopts any
proposed amendments for first-notice publication in the
Illinois Register.
The "mailbox rule"
(35 III. Adm. Code 101.300(b)(2)) does not apply to this filing—therefore, the Clerk's Office
must
receive
the public comment by 4:30 p.m. on September 12, 2008.
