HEARING OFFICER ORDER
The first hearing in this rulemaking proceeding
is scheduled to begin on Monday, January
28,2008, at
10 a.m., in room 9-040, James R. Thompson Center, Chicago. As stated in the
November 20, 2007 hearing officer order, this hearing will be dedicated to presentation
of
testimony and evidence by the l1\inois Environmental Protection Agency (Agency). On January
17, 2008, the Agency notified the hearing officer that one of its witnesses, Mr. Chris Yoder,
would only be available on Monday, Tuesday and Wednesday
of that week.
The Board has received prefiled questions from:
Midwest Generation, L.L.C.
Flint Hills Resources, Joliet Facility
Citgo Petroleum Corporation and PDV Midwest, L.L.C.
Com Products International, Inc.
Chemical Industry Council
of l1linois
Metropolitan Water Reclamation District
of Greater Chicago.
I will attempt to accommodate the Agency based on the stated availability
of Mr. Yoder. The
hearing will begin with the Agency's opening statements and introduction
of witnesses. The
cross-examination
of witnesses will begin with questions for Mr. Yoder. The groups that
prefiled the questions will read the questions, beginning with Midwest Generation and
proceeding
in the order listed above. Thus, when Midwest Generation has finished with
questions for Mr. Yoder we will proceed to Flint Hills Resources and so on.
After we have completed with Mr. Yoder, we will
go back to Midwest Generation's
questions
of the remaining Agency witnesses and proceed in the same manner until all questions
have been asked and answered.
Also
as indicated in November 20, 2007 hearing officer order, prefiling of questions is
not a prerequisite to asking a question. We will begin with questions that have been prefiled;
however, anyone may ask follow-up questions. After completing the prefiled questions, anyone
else may ask a question.
