On October 26, 2007, the Illinois Environmental Protection Agency (Agency)
filed a proposal under the general rulemaking provisions of Sections 27 and 28 of the
Environmental Protection Act (415 ILCS 5/27, 28 (2006)). Generally, the proposal will
amend the Board's rules for Secondary Contact and Indigenous Aquatic Life Uses to
update the designated uses and criteria necessary to protect the existing uses. On
November 1, 2007, the Board accepted the proposal for hearing.
The Board has held 10 days of hearings in this proceeding and will hold several
more hearings in September. The purpose of this hearing will be to allow members of the
public to testify on the proposed rule.
Witnesses will
be sworn in and will be subject to cross-examination. Persons
wishing to testify will be asked to sign in before 5:30 p.m. on June 16 or to contact the
hearing officer by phone or email before that date. The hearing officer may need to limit

the time available for each member to testify depending on the number of people who
wish to testify. The hearing will go no later than 8:00 p.m. and may be adjourned earlier
if all who have signed up to testify have testified.
