JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31.1 of the Illinois Environmental Protection Act, 415
ILCS 5/31.1 (2004).
FACTS
1.
That C. John Blickhan ("Respondent") is the present operator of a facility located at
Lock and Dam Road, Quincy, Adams County, Illinois. The property is commonly known to the
Illinois Environmental Protection Agency as Quincy/Blickhan Landfill.
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No. 0010650002.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That on January 15, 2008, Paul Eisenbrandt of the Illinois Environmental Protection
Agency's Springfield Regional Office inspected the above-described facility. A copy of his
inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.

 
VIOLATIONS
' Based upon direct observations made by Paul Eisenbrandt during the course of his Janaury
15, 2008 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
"Act") as follows:
(1)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004).
(2)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21(p)(3) (2004).
(3)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in deposition of general construction or demolition debris or clean
construction or demolition debris, a violation of Section 21(p)(7) of the Act, 415 ILCS
5/21(p)(7) (2004).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondent is
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500.00) for each of the
violations identified above, for a total of Four Thousand Five Hundred Dollars ($4,500.00). If
Respondent elects not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified above shall be due and payable no later than March 31, 2008, unless otherwise provided
by order of the Illinois Pollution Control Board.

If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500.00) statutory civil penalty for each
violation.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2004), if Respondent fails
to petition or elects not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above.
When payment is made, Respondent's check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondent shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondent from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondent has the right to contest this Administrative Citation pursuant to and in
accordance with Section 31.1 of the Act, 415 ILCS 5/31/1 (2004). If Respondent elects to contest
this Administrative Citation, then Respondent shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601. A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Section 31.1 of the Act provides that any Petition for Review shall be filed within
thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondent.

Affiant, Paul C. Eisenbrandt, being first duly sworn, voluntarily deposes and states as
follows:
1.
Affiant is a field inspector employed by the Division of Land Pollution Control/Field
Operations Section of the Illinois Environmental Protection Agency and has been so
employed at all times pertinent hereto.
2.
On January 15, 2008 between 10:15 AM and 1:00 PM, Affiant conducted an
inspection of a disposal site, located in Adams County, Illinois, and known as Blickhan
by the Illinois Environmental Protection Agency. Said site has been assigned site code
number LPC# 0010650002 by the Illinois Environmental Protection Agency.
3.
Affiant inspected said Blickhan open dump site by an on-site inspection that included
walking and photographing the site.
4.
As a result of the activities referred to in paragraph 3 above, Affiant completed the
Inspection Report form attached hereto and made a part hereof, which, to the best of
Affiant's knowledge and belief, is an accurate representation of Affiant's observations and
factual conclusions with respect to said Blickhan open dump.

The purpose of this memorandum is to serve as the Narrative Inspection Report Document of a
January 15, 2008 annual landfill inspection (of the above referenced site) and inspection of
adjacent properties owned or managed by Mr. C. John Blickhan and Blick's Construction.
While performing the annual landfill inspection, open dumping of used tires and carpet were
observed within the permitted landfill boundary, several open dumping and open burning
violations were observed in an area owned by Mr. C. John Blickhan, commonly known as
Blick's Village, and open dumping of demolition debris was observed on property managed by
Blick's Construction. According to the Corporation Report listed on the Secretary of State's
website, C. J. Blickhan is President of Blick's Construction Co. Inc.
This annual inspection took place from approximately 10:15 am to 1:00 pm, and seventy-four
(74) digital photographs were taken. The weather at the time of the inspection was sunny and
about 30°F with a 5 mph wind from the south. Mr. C. John Blickhan (owner) and Ms. Lori
Graupman (office staff) were interviewed during the inspection.
Photographs 001, 002, 003, and 004 show the west side of Site No. 1 landfill. No debris was
observed on this side of Site No. 1 or in the visible tree line to the south.
Photograph 005 shows three groundwater monitoring wells (G104, G105, & G107) and their
protective casings positioned along the southern edge of Site No. 1. Well identification numbers
were superimposed on photographs 005, 008, and 015.
Photograph 006 shows the northwest side of Site No. 1. No debris was observed.
Photographs 007 and 008 show the north side of Site No. 1. No debris was observed. Photograph
008 shows groundwater monitoring well G101.
Photograph 009 shows the backyard of House No. 6, in Blick's Village, from Lock and Dam
Road. Two rusty metal barrels (one of which is smoking), a blue plastic barrel (seen tipped on its

side), and a light blue trash can are surrounding a pile of debris. Scattered litter was also
observed in the yard.
Photograph 010 shows the main street of Blick's Village Court.
Photograph 011 shows several bags of open dumped waste observed off the north side of House
No. 6's porch.
Photograph 012 shows burn barrels observed behind House No. 3 (west of Site No. 2).
Photographs 013 and 014 show the north west and north east side of Site No 2, respectively. No
debris was observed.
Photographs 015 and 016 show the east side and southeast side of Site no. 2., respectively. No
debris was observed. Groundwater monitoring well G103 and its protective casing are visible in
Photograph 015. The gate seen to the left in Photograph 016 was closed.
Photograph 017 shows the secondary gate that restricts access to Site No. 1 and the Construction
Fill Area. A key was obtained from Blick's Construction Office to unlock the gate and conduct
the inspection. After the inspection the inspector relocked the gate and returned the key to the
office. The primary gate into Blick's Construction is immediately north of the construction
office. The primary gate is left unlocked during business hours.
Photographs 018 and 019 show the Construction Fill Area in the foreground of the photographs.
The south side of Site No. 1 can be seen in the background of the photographs. No debris was
observed on the south side of the Site No.1 .
Photographs 020 and 021 show two debris piles located in the south west corner of the
Construction Fill Area. Construction and demolition debris that included OSB board, painted
and aged dimensional lumber scrap, carpet scraps, lath and plaster, hardwood flooring, cut-offs
from new lumber, plywood, a construction glue adhesive tube, plastic wrapping from Owens
Corning fiberglass insulation, and miscellaneous waste was observed (foreground of pictures).
The larger debris pile seen in the background of Photograph 020 was mostly landscape waste
with some weathered dimensional lumber mixed in.
Photograph 022 shows more fill has been brought into the Construction Fill Area since the last
inspection on November 14, 2006.
Photograph 023 shows concrete, brick, and cinder block fill material. Photographs 024, 025,
026, and 027 show green and/or white painted brick and cinder block. Painted concrete, brick, or
cinder block are classified as demolition waste and must be disposed of properly.
Photograph 028 shows groundwater monitoring well G104. The well was properly locked, had
good drainage, and the protective casing and the concrete surface seal appeared in good
condition.

Photograph 029 shows the south slope of Site No. 1, and the Construction Fill Area.
Photograph 030 shows groundwater monitoring well G105. The well was properly locked, had
sufficient drainage, and the protective casing and the concrete surface seal appeared in good
condition.
Photograph 031 shows groundwater monitoring well G107. The well was properly locked, had
good drainage, and the protective casing and the concrete surface seal appeared in good
condition.
Photograph 032 shows groundwater monitoring well G101. The well was properly locked, had
good drainage, and the protective casing and the concrete surface seal appeared in good
condition.
Photograph 033 shows two open dumped off-rim used tires and carpet scrap observed along the
fence line east of Site No. 1.
Photograph 034 shows an open dumped used tire partially buried along the fence line east of Site
No. 1.
Photographs 035 and 036 show a hole observed in the east side of the landfill cap at Site No.2.
This approximate three foot diameter hole was about two foot deep and appears to have been
formed by settlement. Brick and dirty gravel were observed in the bottom of the hole. Failure to
monitor and remediate landfill settling is apparent violation of Section 22.17(a) and (b) of the
Act.
Photograph 037 shows groundwater monitoring well G103. The well was properly locked, had
good drainage, and the protective casing appeared in good condition. The concrete surface seal
was cracked in the southeast corner, but does not compromise the well's integrity.
Photographs 038, 039, and, 040 show two burn barrels observed west of site No. 2, behind House
No. 3 in the northeast corner of Blick's Village Court. Photographs 039 and 040 show a bag of
household waste in one barrel, and charred debris that includes tin cans, plastic, paper, and
miscellaneous waste among the ashes in both barrels.
Photograph 041 shows a pile of landscape waste covered with leaves behind House No 2 west of
Site No. 2.
Photographs 042 and 043 show three burn barrels located behind House No. 1 west of Site No. 2.
The three barrels contained household waste in white plastic bags. Beneath the bags of garbage
was charred debris and ash.
Photographs 044 and 045 show demolition debris open dumped south of House No. 2. Plastic
sheeting, broken fiberboard, plywood scrap, used dimensional lumber were among the waste in
the pile.

Photograph 046 shows demolition debris in what appears to be a burn barrel near the demolition
debris at House No. 2. The location of the barrel can be seen in Photograph 044.
Photographs 047 and 048 show a BFI Dumpster in front of House No.2. Household furniture
exposed to the weather can be seen outside the front door in Photograph 048. No other dumpster
was observed in Blick's Village. According to one of the tenants, the dumpster belongs to House
No. 2 and is not intended for other residents to use.
Photograph 049 shows trash and garbage strewn across the front yard of House No. 6.
Photograph 050 shows trash and garbage littered on the ground north of House No. 6.
Photograph 051 shows garbage and trash piled on the ground on the north side of the porch at
House Ho. 6.
Photographs 052, 055, 056, 057, 058, and 059 show open dumped demolition debris, household
garbage, and two burn barrels located behind House No.6. Pink fiberglass insulation, fiberboard,
plywood scrap, dimensional lumber, and plastic, were observed in the demolition debris pile. A
red plastic gasoline can was observed near the demolition debris pile. Household waste such as
aluminum cans, clothing, and food packaging were observed around the concrete pad and in the
blue plastic barrel.
Photograph 053 and 054 the contents of the two burn barrels behind House No. 6. One of the
barrels was smoldering. Charred waste, melted aluminum cans, paper, and plastic were among
the ashes in the burn barrels.
Photograph 060 shows additional household garbage stacked behind House No. 6. Three off-rim
used tires were also observed.
Photograph 061 shows a pile of charred waste open dumped in the coppice behind House No. 6.
The pile of charred waste was not present during earlier inspections.
Photographs 062 and 063 show some of the rusty cans, glass, bottles, and plastic bottles littered
among the leaves in the coppice behind House No. 6.
Photograph 064 and 065 shows a copious amount of brick and cinder block demolition waste
among the thicket of small trees behind House No. 5. Photograph 066 shows more open dumped
demolition debris, household waste, and wire fencing behind House No. 5.
Photograph 067 shows the remnants of a rusty burn barrel filled with charred waste behind
House No. 5. Litter was also observed on the ground near the burn barrel.

Photographs 068, 069, and 070 show a pile of demolition debris covered with woody vegetation
located behind House No. 4. The rusty burn barrel seen in photograph 070 was observed full of
waste.
Photograph 071 shows three burn barrels located behind House No. 4. The barrels contained
glass bottles, tin cans, plastic bottles, food packaging, ash and miscellaneous charred waste (as
seen in Photograph 72). Waste was also observed on the ground in front of the burn barrels.
Photograph 073 shows an inoperable brown Chevy Blazer south of House No. 5. The occupant
claimed the vehicle had only been onsite one week and was actively being cut up and recycled.
Photograph 074 shows groundwater monitoring well G106. The well was properly locked, had
good drainage, the concrete surface seal and the protective casing appeared in good condition.
It should be noted that the Illinois EPA inspector investigated debris at Blick's Village Court
several times over the past three years. Repeatedly Mr. Blickhan has been informed about the
alleged open dumping and open burning violations observed on his property.
The apparent violations observed at Blickhan Landfill are indicated on the attached Part 807
Landfill Inspection Checklist. The apparent violations observed at Blick's Village and Blick's
Construction are indicated on the attached Open Dump Inspection Checklist. A site sketch and
digital photographs accompany this narrative.
