ORDER OF THE BOARD (by A.S. Moore):
On September 5, 2007, Stericycle, Inc. (Stericycle) filed a petition for an adjusted
standard (Pet.) from requirements applicable to potentially infectious medical waste (PIMW).
Stericycle sought an adjusted standard from the requirements that it weigh and record the weight
of each load of PIMW at its Stickney transfer station located at 3801 S. Laramie Street, Cicero,
Cook County. Pet. at 1. Specifically, Stericycle requested relief from 35 Ill. Adm. Code
1422.111(b)(1), 1450.105 (a, b), and 1450.200(e), and Condition 15 of its PIMW storage and
transfer facility permit.

In an order dated October 18, 2007, the Board directed Stericycle to file within 30 days
an amended petition addressing specified informational deficiencies. On November 16, 2007,
Stericycle filed a motion to extend the deadline for filing its amended petition. By order dated
November 28, 2007, the hearing officer extended that deadline to December 21, 2007. On
December 20, 2007, Stericycle filed its amended petition (Am. Pet.). Stericycle requests that the
Board grant an adjusted standard from 35 Ill. Adm. Code 1422.11(b)(1), 1450.105 (a, b), and
1450.200(e). Am. Pet. at 1, 18. The Board notes that Stericyle’s amended petition does not seek
an adjusted standard from Condition 15 of its permit.
See id
. Accordingly, as reflected above,
the Board amends the caption in this proceeding in order to reflect the amended petition.
As it did in its original petition, Stericycle states in its amended petition that “[u]nless an
objection is raised by the [Illinois Environmental Protection] Agency or a hearing is requested by
a member of the public or an interested party, Stericycle hereby waives hearing in this matter.”
Am. Pet. at 17, Pet. at 10;
see
35 Ill. Adm. Code 104.406(j). The Board notes that it has received
no request to conduct a hearing in this proceeding.
The Board accepts Stericycle’s amended petition. Accordingly, the Board directs the
Illinois Environmental Protection Agency to file its recommendation on or before Monday, April
7, 2008, the first business day after 45 days from the date of this order.
See
35 Ill. Adm. Code
104.416(a). Stericycle “may file a response to the recommendation within 14 days after the date
of service of the recommendation.” 35 Ill. Adm. Code 104.406(d).
IT IS SO ORDERED.

I, John T. Therriault, Assistant Clerk of the Illinois Pollution Control Board, certify that
the Board adopted the above order on February 21, 2008, by a vote of 4-0.
