REQUEST FOR PROVISIONAL VARIANCE
On February 12, 2007, the Illinois Environmental Protection Agency ("Illinois
EPA") received from Ampac Flexibles a request for provisional variance to continue
operating its flexographic press and two laminators until a replacement regenerative
thermal oxidizer ("RTO")
is installed and operational at its facility located in Cary
. The
request was accepted for review pursuant to the requirements of Sections 35, 36, and 37
the Illinois Environmental Protection Act
("Act")
(415 ILCS 5/35, 36, and 37) and the
applicable regulations .
Illinois EPA evaluated the request pursuant to the requirements of Sections 35,
36, and 37 of the Act and the Illinois EPA regulations at 35 Ill
. Adm. Code Part 180 . The
Illinois EPA is granting the request for provisional variance as the source has
demonstrated that an arbitrary and unreasonable hardship will result in the event of a
denial
.
Ampac Flexibles seeks provisional variance from conditions 7
.1 .6(b) and 7 .2.6
in
Clean Air Act Permit Program ("CAAPP") permit #95090019, as well as from 35 Ill
.

 
Adm. Code 218 .204, 218 .207, 218 .401, and 218 .404
. These requirements control the
emissions of volatile organic material ("VOM")
. The Illinois EPA is granting relief to
Ampac Flexibles from the applicable requirements from conditions 7
.1 .6(b) and 7.2.6 in
CAAPP permit #95090019,
as well as from 35 Ill . Adm. Code 218 .204, 218.207,
218 .401, and 218.404. Relief is granted beginning February
15, 2007, until such time as
a new RTO is installed, or through March
31, 2007, whichever occurs first.
The Illinois EPA grants Ampac Flexibles regulatory relief by this provisional
variance subject to the following conditions :
By April 30, 2007, Ampac Flexibles shall provide the Illinois EPA a
written report of the total tons of VOM emitted during the term of the
provisional variance with supporting calculations for each line

During the term of this provisional variance, while operating its
flexographic press and two laminators, Ampac Flexibles shall take all
reasonable steps to minimize VOM emissions .
Within three days from the date of this document, Ampac Flexibles shall execute
and submit to the Illinois EPA a Certificate of Acceptance and Agreement ("Certificate"),
accepting regulatory relief granted by this provisional variance and signed by a
responsible person or official authorized by the owner to represent the owner in all
matters pertaining to this provisional variance
. The Certificate shall provide as follows :
