On January
22, 1986,
C.
Groot Automatic Disposal
Co.
(Groot)
filed
a letter which
it stated constituted
an appeal of certain
monitoring conditions
in its NPDES issued January
7,
1986.
On
January 23,
1986,
the Board found
the petition deficient and
afforded Groot 45 days
in which
to
file an amended petition
curing
the deficiencies.
On March
11,
1986,
the Board received
a
memorandum from the Illinois Environmental Protection Agency
which
stated
that Groot did not
intend
to file an amended
petition but was going
to comply with its NPDES permit as
issued.
Based
on this information,
the Board hereby dismisses
this proceeding
for failure
to file an amended petition within 45
days
of
the Board’s January 23,
1986 Order.
