    ORDER OF THE
    BOARD
    (by C.A. Manning):
    On July 10,
    1995, Stone Container Corporation (Stone
    Container)
    filed a notice of extension of the 35-day appeal
    period pursuant to Section 40 of the Act, relating to a May 30,
    1995 Illinois Environmental Protection Agency
    (Agency)
    determination regarding Stone Container’s supplemental permit
    application.
    The Agency on July 18, 1995 filed its agreement to
    the extension dated July
    14,
    1995.
    By order of August 3,
    1995,
    the Board reserved Docket PCB
    96-4 for any amended petition’ which might be filed by the Stone
    Container.
    The order stated “If the amended petition is not
    filed on or before October
    4,
    1995,
    this matter will be
    dismissed.”
    No amended petition has been filed.
    This matter is
    dismissed and the docket
    is closed as unnecessary.
    IT IS SO ORDERED.
    Section 41 of the Environmental Protection Act,
    (415 ILCS
    5/41
    (1994)), provides for appeal of final orders of the Board
    within 35 days.
    The Rules of the Supreme Court of Illinois
    establish filing requirements.

    ‘The Board accepted Stone Container’s notice of extension as
    a petition for review due to the late filing of the Agency’s
    agreement to the extension.
