ILLINOIS POLLUTION CONTROL BOARD
March
10,
1988
IN THE MATTER OF:
PROPOSED SITE—SPECIFIC WATER
POLLUTION RULES AND REGULATIONS
APPLICABLE TO CITIZENS UTILITIES
)
R81—19
COMPANY OF ILLINOIS’ DISCHARGE
TO LILY CACHE CREEK
)
ORDER OF THE BOARD
(by J. Theodore Meyer):
This matter
is before the Board on
a February 25,
1988
motion to strike filed by the Illinois Environmental Protection
Agency (Agency).
The Agency asks that several portions of
the
January 11,
1988 brief
filed by Citizens Utilities Company of
Illinois
be stricken.
The Agency alleges
that those portions
refer
to facts which are outside of
the record
in this
proceeding.
On March
7,
1988, Citizens filed objections
to the
motion
to strike.
The Board finds that the portions
of the brief which are
objected to by the Agency make reference
to facts which
are
properly
a part
of the record,
or
facts of which this Board may
take official notice.
Therefore,
the motion to strike
is denied.
IT
IS SO ORDERED.
R.
Flernal abstained.
