1988, the Trojan Corporation
(Ensign—
Bickford Company, operator)
filed
a petition for variance under
the signature of W.J. Caplan, Plant Manager, Wolf Lake
Facility.
That petition is deficient in that
it:
1.
fails
to specifically request or waive
a
hearing
in this matter,
as required by
35
Ill. Adm.
Code 104.124.
If hearing
is
waived, an affidavit in support of the
facts alleged
in the petition
is
required.
In addition, the Board received a subsequent filing on
September
22,
1988,
under
the signature of Curtis L. DeMille,
Environmental Manager.
The Board
is uncertain whether this
subsequent filing represents an amended petition or some change
in Trojan’s request for variance.
The Board requests that Trojan
clarify the intent of its second filing.
Unless
an amended petition is filed within
45 days of the
date of this Order, curing
the above—noted defect,
this matter
will
be subject
to dismissal.
