ILLINOIS POLLUTION CONTROL
BOARD

JOHN
& LUELLA WOJCEK
)
v.
)
PCB 71—350
ENVIRONMENTAL PROTECTION AGENCY
OPINION AND
ORDER
OF THE
BOARD
(by Mr.
Kissel):
On November
4,
1971,
John and Luella Wojcek filed a petition
for variance with the Board asking the Board to allow the Wojceks
to connect a home sewer line to that of the North Shore Sanitary
District.
The variance would be from paragraph 7 of the Board’s
order in the case of the League of Women Voters et al
v. North
Shore Sanitary District,
PCB 70-7.,
et seq. March 31,
1971.
The petition for variance does not, however, contain suffi-
cient facts for the Board to make a decision.
Some of the facts
which the Board does not know are the following:
1.
What have the Wojceks done to the lot since
the date of.~rchasein 1955?
2.
When was construction begun on the home?
3.
Can a septic field be used
and, if so, at what
cost?
Is the cost a hardship and, if so, why?
There may be other facts which would demonstrate that not granting
a variance to the Wojceks would create an
“arbitrary or unreason-
able’t hardship.
It
is not enough that the Wojceks have owned the
lot for some time,
if
they did nothing prior to March 31,
1971
to
build the house.
We need much more information and if it is not
provided within twenty
(20)
days of this order, the petition will
be dismissed.
It is so ordered.
I, Christan Moffett, Acting Clerk of the Pollution Control
Board, hereby~certifythat the Board adopted the above opinion and
order this
~,
day of December,
1971.
