OPINION AND ORDER OF THE BOARD
(by Mr. Dumelle)
Petition was filed April
12 asking
a variance from Rule
3-
3.112 of the Air Regulations
“in the event boilers
#4,
5,
6,
and
7,
or any of them,
fail
as
a result of the tests
to meet the
current particulate emission standards”
(Pet.
p.
3).
Since no violation of standards
is yet proven the petition
is premature.
The Village of Winnetka may file again after its
particulate tests
are completed by May 31,
197’3.
The variance petition is dismissed as being premature without
prejudice.
IT
IS SO ORDERED.
I, Christan L. Moffett, Clerk of the Illinois Pollution Control
