    ORDER OF THE BOARD
    (by Mr.
    Henss):
    Ferndale Heights Utilities Company has
    filed an Application
    for Stay of Order Pending Judicial Review.
    It has been the
    policy of the Board to stay the payment of monetary penalties
    while Board decisions are being reviewed by the Courts.
    The
    Board has usually denied the stay of any of its Orders which
    direct a company to come into compliance with environmental
    standards.
    The order
    in this case
    is for payment of a monetary
    penalty and a stay will be granted consistent with Board policy.
    It is Ordered that the July 10,
    1975 Order which directed
    Ferndale Heights Utilities Company to pay to the State of
    Illinois by August 25,
    1975 the sum of $500.00 as
    a penalty for
    violations
    of Rule 102, Noise Regulations and Section 24,
    Environmental Protection Act be stayed until the Pollution
    Control Board has received
    a mandate of the reviewing court.
