ILLINOIS POLLUTION CONTROL BOARD

CITY
OF
ELMHURST
v.

71—389
ENVIRONMENTAL PROTECTION AGENCY
Opinion
&
Order of the Board
(by Mr.
Currie)
r~he
City of Elmhurst petitioned for
an extension of
the SWB-l4 date for completion of advanced treatment
facilities
at its sewage treatment plant.
Since the petition
was
filed we adopted
a new regulation,
#R 71—14, March
7,
1972,
which
in view of changes
in the applicable treatment require-
ments has set
a new date
for advanced treatment throughout the
State.
Since
the City’s program will bring it into compliance
in advance
of the new deadline,
no variance appears necessary.
The case
is therefore moot
and is hereby dismissed.
If upon
examination
of the new regulations and consultation with
the
Agency there appears to be any need for Board action,
a renewed
petition may
always
be
filed,
and
the relevant
facts,
or many
of
them, are already
in the record.
I,
Christan Moffett,
Clerk of the Pollution Control Board,
certify
th4at
the Board adopted the
above Opinion
& Order
this
.
