ORDER OF THE BOARD
(by J. Anderson):
On October
23,
1987, North Hills Mutual Sewer Association
(NHMSA)
filed a motion
to vacate the Board’s Order
of August 14,
1986
and for NHMSA’s dismissal as
a party.
No responses have
been filed
to
this motion.
While
it
is apparent from the notice
of filing and proof
of
service
that the Agency and the Attorney General have been served
with
this motion,
it
is unclear whether Vickery Manor has been
so
served.
The
trxird person to whom the motion is addressed
is
Joseph
S.
Wright, Jr.
of the firm Martin,
Craig, Chester
and
Sonnenschein, who has filed
no appearance
in
tnis matter.
The
Board’s
records show the only appearance
on behalf of Vickery
Manor
as having been made by Andrea Sykes Foote and Robert A.
Knuti
of
the firm Lord,
Bissell and Brook.
The Board will take no action on tnis motion until
1)
it
has received proof of service
of the motion on counsel who has
filed
an appearance on Vickery Manor’s behalf,
and
2)
the time
for response
to the properly served motion has
run.
To aid
clarification of
this problem of representation,
the Clerk’s
Office
is directed
to make service
of this motion on Mr. Wright
by first
class mail only,
in addition
to making usual service of
the motion on the attorneys who have filed appearances.
IT IS SO ORDERED.
