Dear Marie :

I am writing to thank you and the members of the Illinois Pollution Control Board for the

time and energy that you and the Board put into the above referenced rulemaking. Most

of all I would like to ask that you thank Acting Chairman Girard and the other members

of the Board that participated in the rulemaking for their decision to dismiss Subdocket

B .

Although I still believe that the goal of more closely regulating professional consulting

costs is an admirable and needed goal for the Illinois UST program, the rule that was

before the Board in Subdocket B was unworkable and economically irresponsible and I

agree that it was very unlikely that the insufficiencies in the record could be cured. The

Board was wise in dismissing the Subdocket and I thank them for their prudence and

objectivity in the process

.

Hopefully, the Board's recommendation, that this matter be taken up by the LUST

Advisory committee, will serve to allow the two sides in this matter to work through their

differences and develop, over time, a mutually agreeable means to achieve the goal of

regulating professional consulting costs on a per task basis

.
