    IN DISASTER AREAS
    ORDER OF THE BOARD
    (by Mr. Dumelle):
    On January
    31, 1979 the Agency requested that Rules
    501(i)
    and 501(j)
    of the Air Pollution Control Regulations be amended.
    The Agency’s proposal
    is the same as the one filed by the Agency
    in this proceeding on April
    13,
    1978.
    The impetus for this recent
    request is the January 14, 1979 and January 26, 1979 declaration
    by the Governor, James
    R.
    Thompson that
    47 counties in Illinois
    are disaster areas
    as a result of damage from the recent severe
    weather.
    The Board hereby finds that the Governor’s action enables
    the Board to act pursuant to Section 27(c)
    of the Act.
    For a
    period of 150 days from the date of this Order, Rules
    501(i)
    and
    501(j)
    of the Air Pollution Control Regulations shall be amended
    to read as follows:
    Rule 501(i)
    “Disaster:
    A major disaster declared
    pursuant to the U.S.
    Disaster Relief Act of 1970,
    Public Law 91-606, or declared by the Governor of
    the State
    of Illinois pursuant to Section 1108 (a)
    of the Emergency Services and Disaster Operations Act
    of 1975 as amended, Chapter 127 of the Illinois Re-
    vised Statutes.”
    Rule 501(j)
    “Disaster Area:
    Area in which a major
    disaster has been declared pursuant to the U.S.
    Disaster Relief Act 1970, Public Law 91—606,
    or
    declared by the Governor of the State of Illinois
    pursuant to Section 1108(a)
    of the Emergency Services
    and Disaster Act of 1975 as amended, Chapter 127 of the
    Illinois Revised Statutes.”
    These amendments
    shall apply only in those 47 counties listed
    in the Governor’s declarations.
    These amendments shall take effect
    immediately.
    Hearings on the merits of this proposal will convene as
    soon as possible.
    In its evaluation of this proposal,
    the Board
    will consider whether or not these amendments should be adopted
    permanently on a statewide basis.
