ORDER OF THE BOARD (by C.A. Manning):

On May 16, 2002, the Board, at the parties’ request, extended until August 1, 2002, the
time period within which Illinois Valley Paving Company (Illinois Valley) may appeal a
March 26, 2002 determination of the Illinois Environmental Protection Agency (Agency).
    See

    415 ILCS 5/40 (a)(1) (2000)
    amended
    by P.A. 92-0574, eff. June 26, 2002; 35 Ill. Adm. Code
105.406. The Agency rejected the high priority corrective action plan regarding a leaking
underground storage tank at Route 106 West, Winchester, Scott County. Because Illinois
Valley failed to timely file an appeal, the Board dismisses this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the
Board adopted the above order on August 8, 2002, by a vote of 7-0.
