Code 306.373 provides that no petition shall be

accepted by the Board after January

1,

1986.

However,

the Board

notes

that

this petition was mailed to the Board’s old address

via certified mail

on December

26, 1985.

Given the fact that the

current

(1982) printed version of the Board’s procedural rules

list the old address, as well

as the holiday—related

slow—down

of

mail service,

the Board will accept the petition,

finding that

the City has substantially complied with the filing deadline.

Hearing in this matter will be scheduled as expeditiously as

is

practicable,

consistent with the need of the Board and the Agency

to coordinate and prioritize

the handling of this and the other

recently filed petitions.
