MOTION FOR RELIEF FROM DEADLINE
TO CERTIFY RECORD
NOW COMES, Respondent, the Peoria County Board, by and through its
attorneys, and for this Motion for Relief from Deadline to Certify the Record, states as
follows
:

On or about June 7, 2006, the Pollution Control Board issued an Order
requiring the County to file the entire record of its proceedings within 21 days after the
date of the Order .

On or about June 15, 2005, the Board's Order was adopted, which would
require the County Clerk to certify the record on or before July 6, 2006
.

On or about June 21, 2006, counsel for the County first received the Order,
and immediately forwarded it on to the County Clerk .

Since receipt of the Order, the County Clerk has been diligently compiling
and organizing the various documents and materials that comprise the Record of the
proceedings before the County on the application
.

Despite the County Clerk's best efforts, the Clerk does not reasonably
believe its office will be able to compile, copy, and certify the entire Record before the
presently set deadline
.

At the present time, the County Clerk's best estimate of the size and volume
of the Record is that it will consist of approximately 50 banker's boxes of documents and
contain close to 1 million pages
.
7 .
Due to the size of the record and sheer number of documents and pages, the
Clerk cannot reasonably comply with the presently set deadline .

Based upon the Clerk's best estimates, the County Clerk reasonably believes
it can compile, copy, and certify the record on or before August 7, 2006 .

The Clerk will continue to diligently work toward completion of certifying
the record, and if reasonably possible, will do so before the proposed August 7, 2006,
date .
WHEREFORE, the County respectfully requests the Hearing Officer grant the
County relief from the presently set deadline of July 6, 2006, and extend the deadline to
August 7, 2006
.
