HEARING OFFICER ORDER
As set forth below, this order establishes a pre-first notice deadline for filing public
comments with the Board. By way of background, on September 30, 2005, the Board received a
rulemaking proposal from the Illinois Environmental Protection Agency (Agency) to amend the
Tiered Approach to Corrective Action Objectives (TACO) rules (35 Ill. Adm. Code 742)
. On
October 20, 2005, the Board accepted the Agency's TACO proposal for hearing . The Board has
held two hearings: January 31, 2006 in Chicago, and March 1, 2006 in Springfield
.
April 17, 2006 is the deadline for filing written public comments with the Clerk's Office
before the Board proceeds to first notice . As discussed at hearing, commenters are encouraged to
include their views on how the Board should address, procedurally, the concerns raised in this
record about "Acceptable Detection Limits" and other laboratory issues
. For example, the
Board's procedural options include addressing the matters in this docket; holding another hearing
before first notice; opening a different docket .
Each public comment should identify this rulemaking docket, R06-10
. If the Board
proceeds to first notice, there will be other opportunities to file public comments in this
rulemaking. Filing by April 17, 2006, however, ensures that your comment will be considered by
the Board before the Board adopts any proposed amendments for first-notice publication in the
Illinois Register.
