ORDER OF THE BOARD
(by Mr. Goodman):
American Can Company
(American)
filed an amended petition for
variance from Rule
205(f) (2) (D)
of the Air Regulations on July
21,
1975.
On August 14,
1975,
the Pollution Control Board
(Board)
accepted that amendment.
No further action has been taken in this
matter.
Due
to the fact that the compliance date for Rule 205(f) (2)
(D) has been extended until May 30,
1977, the Board finds the instant
petition to be inappropriate and will dismiss this action.
It is the Order of the Board that American’s petition for
variance from Rule 205(f) (2) (D)
be and is hereby dismissed without
prejudice.
