This matter
conies before the Board upon receipt
of
an
Agency
recomiiendation
for provisional variance;
the recommendation was
filed on October
19,
1988.
The recommendation concerns
a
request by Frantz
Manufacturing Company
to allow on—site storage
of hazardous
wastes beyond the 90—day limit
imposed by 35
Ill.
Adm.
Code
722.134(b).
The Agency has concluded
that the necessity for the
hazardous waste
to remain on—site was due
to unforeseen,
temporary and uncontrollable circumstances;
and that
failure to
grant the requested provisional variance would impose an
arbitrary
and unreasonable hardship on Petitioner.
The Agency
urges
this Board
to grant
the requested provisional variance.
The Board does hereby grant provisional variance
to Frantz
Nanufacturing Company,
to
allow on—site storage
of hazardous
wastes
from September
2,
1988 until October
2,
1988.
