HEARING OFFICER ORDER
On December 15, 2005, all parties participated in a telephonic status conference
with the hearing officer. The respondent represented that it has ratified the bid for the
installation of the low sound fan blade and is presently discussing a timeline for its
installation. What remains, however, among other things, is whether this low sound fan
blade will fall within the nighttime sound limits. The respondent and the complainants
anticipate that discussions will be held prior to the next status conference regarding this
issue.
The parties were notified that, if needed, continuing with the discovery process
will be revisited at the next status conference.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on January 25, 2006, at 11:30 a.m. The
telephonic status conference must be initiated by the complainant, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
