    OPINION AND ORDER OF THE
    BOARD
    (by Mr. Henss)
    Petitioner International Harvester Company requests a
    variance in its Project Completion Schedule to extend the
    time when its waste treatment system will be in operation
    from March 1973 to May 1973.
    Both dates are prior to the
    December 31, 1973 deadline established by Rule 408 Chapter 3
    of our Regulations on Water Pollution.
    Petitioner had
    committed itself in
    a Project Completion Schedule to achieving
    compliance nine months prior to the deadline.
    Delays in
    delivery of the proper equipment made it impossible for
    International Harvester to meet the agreed March deadline.
    The EPA states that the May date for compliance
    is acceptable,
    but believes that the Petitioner could accomplish its purpose
    by filing an Amended Project Completion Schedule.
    The Agency
    recommends that the Variance not be granted and that Petitioner
    be directed to file an Amended Project Completion Schedule.
    We see no reason to require that Petitioner take a
    different procedural approach.
    The matter is before us and
    easily decided.
    The variance is granted to May 8,
    1973.
    It is so ordered.
